A. Any
person charged with an offense for which payment of a fine may be
made to the Violations Bureau shall have the option of paying such
fine within the time specified in the notice of arrest at the Violations
Bureau upon entering a plea of guilty and upon waiving appearance
in court; or may have the option of depositing required lawful bail,
and upon a plea of not guilty shall be entitled to a trial as authorized
by law.
B. The
payment of a fine to the Bureau shall be deemed an acknowledgement
of conviction of the alleged offense, and the Bureau, upon accepting
the prescribed fine, shall issue a receipt to the violator acknowledging
payment thereof.

A. The
following duties are hereby imposed upon the Violations Bureau in
reference to offenses:
1. It shall accept designated fines, issue receipts, and represent in
court such violators as are permitted and desire to plead guilty,
waive court appearance, and give power of attorney;
2. It shall receive and issue receipts for cash bail from the persons
who must or wish to be heard in court, enter the time of their appearance
on the court docket, and notify the arresting officer and witnesses,
if any, to be present.

The Violations Bureau shall keep records and submit to the judges
hearing violations of City ordinances summarized monthly reports of
all notices issued and arrests made for violations of the traffic
laws and ordinances in the City and of all the fines collected by
the Violations Bureau or the court, and of the final disposition or
present status of every case of violation of the provisions of said
laws and ordinances. Such records shall be so maintained as to show
all types of violations and the totals of each. Said records shall
be public records.

The Violations Bureau shall follow such procedure as may be
prescribed by the traffic ordinances of the City or as may be required
by any laws of this State.

A Violations Bureau shall be established at the City with the
City Clerk or Deputy Clerk designated as the Violations Clerk for
the Violations Bureau. Such Violations Bureau shall be operated within
the procedures as established by the rules of the Supreme Court of
the State for Violations Bureaus. The City shall be entitled to keep
the court costs of cases paid through the Violations Bureau at the
City. The duties of the Violations Bureau Clerk shall include, but
not necessarily be limited to, all duties designated by the court,
specifically to include, accepting appearances, waivers of trial,
pleas of guilty, and payments of fines and costs in traffic offenses,
subject to the limitations hereinafter prescribed. The Violations
Bureau shall take all actions necessary to allow any person charged
with a traffic offense, except those requiring court appearance, to
be eligible to deliver by mail or otherwise the specified amount of
the fine and costs to the Violations Bureau. A schedule of all fines
and costs shall be posted with the Violations Bureau at all times.

A. The
following rules shall govern the disposition of traffic records:
1. Every Police Officer, upon issuing a traffic citation to an alleged
violator of any provision of the motor vehicle laws of this State
or of any provision of this Title or other traffic ordinance, shall
deposit the original and a duplicate copy of the citation at the direction
of the Chief of Police, who shall cause the original to be delivered
to the Municipal Court and the duplicate copy to the central records
section of the Police Department.
2. Upon the filing of such original citation in the Municipal Court
of this City as aforesaid, such citation may be disposed of only by
trial in such court or by other official action, including forfeiture
of bail or by payment of a fine to the Violations Bureau of such court.

A. All
traffic offenses shall be within the authority of the Violations Bureau
and the Violations Bureau Clerk, except for the following:
1. Any violation resulting in personal injury or property damage.
2. Any violation alleging the operation of a motor vehicle while intoxicated
or under the influence of intoxicants or drugs.
3. Any violation alleging the operation of a vehicle with a counterfeited,
altered, suspended, or revoked license.
4. Any violation alleging the defendant was fleeing or attempting to
flee or elude an officer.
