The Wetlands Board of the City of Fredericksburg is hereby created.

A. 
The Wetlands Board shall have all the powers and duties conferred upon it by Code of Virginia, § 28.2-1300 et seq., and by § 72-34.4 of this Code, to regulate tidal wetlands.[1]

B. 
The Board shall conduct studies of the City's tidal and nontidal wetlands and make periodic reports and recommendations to the City Council on ways that the City can protect and preserve all such areas within the City. In making its reports and recommendations, the Board shall consider the effects of the potential land use and development of such wetlands on the Rappahannock River and the quality of state waters.

A. 
The Wetlands Board shall consist of seven residents of the City, who shall be appointed by the City Council. Their terms of office shall be for five years, except that original appointments shall be made for such terms that the term of one member shall expire each year. A member whose term expires shall continue to serve until his successor is appointed and qualified. Members may serve successive terms.
B. 
The chair of the Board shall notify the City Council at least 30 days in advance of the expiration of any term of office and shall also notify the City Council if any vacancy occurs. Appointments to fill vacancies shall be for the unexpired portion of the term.
C. 
Members of the Board shall hold no other public office in the City except that they may be members of the Planning Commission, Directors of soil and water conservation boards or local erosion commissions, or members of the Board of Zoning Appeals. When such members are appointed, their terms of appointment shall be coterminous with their membership on the Planning Commission, soil and water conservation boards or local erosion commissions, or the Board of Zoning Appeals.

The Wetlands Board shall elect from its membership a chair and such other officers as it deems necessary, who shall serve one-year terms as such and may succeed themselves. For the conduct of any hearing and the taking of any action, a quorum shall be not less than four members. The Board may make, alter, and rescind rules and forms for its procedures, consistent with ordinances of the City and general laws of the commonwealth. The Board shall keep a full public record of its proceedings and shall submit a report of its activities to the City Council at least once each year, and a copy of its report to the Virginia Marine Resources Commission.
