The Chief of Police shall be appointed by the Mayor with the consent and approval of a majority of the members of the Board of Aldermen.

The Chief of Police shall be in charge of and in control of the Police Department.

The Chief of Police in the discharge of his/her duties shall conduct himself/herself in accordance with such rules and regulations as may be prescribed by the Public Safety Committee and shall be under the supervision of the Mayor and Board of Aldermen.

Subject to the provisions of this Chapter, the Chief of Police shall have the right to determine the assignments to be given to the various Police Officers of his/her department.

A. 
The Chief of Police shall be custodian of all property seized or held for evidence, and after the disposition of the cause (including the time for appeals from any conviction) in which any property shall be used as evidence, such property, if of such nature that its possession or sale is unlawful, shall be destroyed. If such property is proved to be stolen property and its possession or sale is not unlawful, and the owner of the same is not known, the Chief of Police may, after ninety (90) days from the disposition of the cause (including the time for appeals from any conviction) in which the property was used as evidence, sell the same to the highest bidder, for cash, at a public sale, which such sale may include sale at auction by electronic means. All proceeds shall be deposited in the General Fund of the City.
B. 
The Chief of Police shall begin investigating lost or stolen property immediately after it is found or recovered. In the event the owner is identified, the owner shall be notified by the Chief of Police and arrangements shall be made for the return of the property.
C. 
The Chief of Police may order the disposal of any unclaimed lost or stolen property. The property must have been in the possession of the Chief of Police for a period of ninety (90) days and must have remained unclaimed during that period.
D. 
All unclaimed property described in Subsection (C) may, but is not required to be, transferred to other agencies or departments of the City. All other unclaimed property described in Subsection (C) which is not so transferred to another agency or department shall be sold to the highest bidder, for cash, at a public sale, which such sale may include sale at auction by electronic means. All proceeds shall be deposited in the General Fund of the City.
E. 
Notwithstanding the foregoing, no sale of property having an estimated value in excess of ten thousand dollars ($10,000.00) shall be made pursuant to this Section 200.120 without the prior approval of Ways and Means.
F. 
The use of an auction company is expressly authorized by this Section 200.120.
