The City of New Melle, Missouri, shall be authorized to make,
adopt, amend, extend and carry out a municipal plan as authorized
by law.

There is hereby established within and for the City a Planning
and Zoning Commission which shall consist of not more than fifteen
(15) nor less than seven (7) members including the Mayor, if the Mayor
chooses to be a member; a member of the Board of Aldermen selected
by the Board of a six (6) month term, if the Board chooses to have
a member serve on the Commission; and not more than fifteen (15) nor
less than five (5) citizens appointed by the Mayor and approved by
the Board of Aldermen. For purposes of this Section, the term “citizen” shall be defined as any person who
is a resident of the City. The term of each of the citizen members
shall be for four (4) years, except that the terms of the citizen
members first appointed shall be for varying periods so that succeeding
terms will be staggered. All members shall be recommended by the Planning
and Zoning Commission to the Mayor and shall be approved by the Board
of Aldermen and shall serve without compensation. The City Engineer
shall serve as advisor to the Planning and Zoning Commission. A quorum
shall be a simple majority of the appointed members. Any vacancy in
a membership shall be filled for the unexpired term by appointment
as aforesaid. The Board of Aldermen may remove any citizen member
for cause stated in writing and after public hearing.

The City Planning and Zoning Commission shall elect its Chairman,
Vice Chairman and Secretary from among the citizen members. The term
of Chairman and Secretary shall be for one (1) year with eligibility
for re-election. The term of each of the citizen members shall be
for four (4) years and will be eligible for reappointment after review
by the Board of Aldermen. The term for a non-resident member is one
(1) year.

The City Planning and Zoning Commission shall hold regularly
scheduled meetings and special meetings as they provide by rule. The
Commission shall adopt rules for the transaction of business and shall
keep a record of its resolutions, transactions, findings and determinations,
which record shall be a public record. Any member of the Planning
and Zoning Commission who within any twelve (12) month period has
three (3) unexcused absences or a total of five (5) absences shall
be subject to immediate removal by the Board of Aldermen for neglect
of duty unless there are extenuating circumstances. Any member being
more than thirty (30) minutes late to a meeting shall be charged with
one-half (½) of an unexcused absence.
All public officials shall upon request furnish to the Planning
and Zoning Commission, within a reasonable time, all available information
it requires for its works.

The Board of Aldermen may provide the funds, equipment and accommodations
necessary for the work of the Commission, but the expenditures of
the Commission shall be within the amounts appropriated for that purpose
by the Board of Aldermen and no expenditures, nor agreements for expenditures,
shall be valid or legal in excess of such amount.

It shall be the function and duty of the Commission to develop and review plans for the physical development of the municipality, including any area outside of its boundaries but within its statutory authority which, in the Commission's judgment, bear relation to the planning of the municipality, including site plans as provided in Chapter
405, Art.
XIII.
In general, the Planning and Zoning Commission shall have the
power necessary to enable it to perform its functions and promote
City planning. The Planning and Zoning Commission shall have the power
to perform all of the functions of the Zoning Commission provided
for in Chapter 89, RSMo., and shall have and perform all of the functions
of a Planning Board as outlined in such Chapter.

A. The
Commission, from time to time, shall recommend to the appropriate
public officials the following:
1. Review and make recommendation on all rezoning requests.
2. Review and make recommendation on all conditional use permit requests.
3. Review and make recommendation on all amendments to the zoning ordinance
and the subdivision regulations.
4. Review and make recommendation on all applications for site plan
approval.
5. Review and make recommendations on all applications for preliminary
plat approval.
6. Review and make recommendations on the Comprehensive Plan.
7. Review all directory signs as to their height and overall square
feet.
8. Review all requests for County rezoning and platting, for areas located
within one and one-half (1½) miles of the City limits and send
its recommendations to the Board of Aldermen for their final review
and recommendation to the County.
9. Advisory items to the Board of Aldermen as requested by the Board
of Aldermen.
10. Recommend programs for public structures and improvements and for
the financing thereof.
11. Provide administrative direction to the City Engineer in their execution of Zoning Code enforcement as defined in Chapter
405, Art.
XIV.
12. Review and make recommendation on the update of the City's zoning
ordinances.
B. It
shall be the function and duty of the Commission to further consult
and advise with public officials and agencies, civic organizations,
public utility companies, educational, professional and other organizations
and with citizens with relation to the promulgation and carrying out
of the plan. The Commission shall have the power to delegate authority
to any of the above named groups to conduct studies and make surveys
for said Commission it deems expedient with the approval of the Board
of Aldermen.
C. The Commission shall, from time to time, review applications, issue reports and make recommendation to the Mayor and Board of Aldermen on amendments to the zoning map as provided in Chapter
405, Article
III: Planned Unit Developments as provided in Chapter
405, Article
V and all other powers and duties ascribed to them by this Title.
