§ 297-1 Purpose.

The Borough of Oceanport recognizes the need to review requests and establish formal scheduling procedures for the use of its public buildings (hereinafter referred to as "buildings") by the public. Buildings owned by the Borough of Oceanport will be available for use by the public, groups or individuals. All parties utilizing the buildings must adhere to all Borough rules and regulations as adopted by resolution of the governing body. A copy of the rules and regulations shall be given to each applicant upon application.

§ 297-2 Building availability and use.

A limited number of established buildings are available for use in the Borough of Oceanport. These include the Blackberry Bay Pavilion, the Old Wharf House and the Port Au Peck Firehouse.
The Borough of Oceanport reserves all rights to schedule, reschedule, restrict or limit date availability for any reason. The Borough of Oceanport specifically reserves the right to cancel any building use at any time for any reason.
No alterations to existing buildings shall be allowed without prior approval from the Borough of Oceanport Municipal Council by way of resolution.
Parties reserving buildings will be held responsible for the behavior and actions of all parties present at the event. Parties reserving the buildings shall be responsible for any and all damage resulting from the misuse of any Borough of Oceanport buildings or property. All parties must inspect the building and adjacent area for trash, recyclables and other litter at the conclusion of their use and dispose of it properly in the receptacles provided. The Borough of Oceanport reserves the right to bill the group that utilized the building for clean-up of the building and adjacent property if the Borough deems that there was excessive litter left at the athletic facility or adjacent property after use.
Any violation of the Borough of Oceanport rules may result in the individual or group being unable to utilize an Oceanport building for the period of six months from the date of violation.
A second violation shall result in a suspension of reservation privileges for one year from the date of the violation.
The time and materials expended by the Borough of Oceanport in repairing damage or conditions caused by the parties or guests of the parties due to their actions or misuse will be withdrawn from the required security deposit and any excess billed to the party at the Borough of Oceanport Municipal Council's discretion.

§ 297-3 Fees and charges.

Permit fees are based upon a per-event, per-facility fee. Fees for building use are contained within the Borough of Oceanport Fee Ordinance, Chapter 204.

§ 297-4 Scheduling procedures.

Rental of the Old Wharf House shall be subject to vacation of the building by the Borough offices, with priority given for the use of the building to the Oceanport Senior Citizens Club.
Rental of the Port-Au-Peck Firehouse shall be subject to the availability as determined by the Port-Au-Peck Chemical Hose Co.
The date of receipt of a building use request shall be the date that the request is deemed made.
All building use requests shall be made to the Borough Clerk's office.

§ 297-5 Insurance coverage.

Prior to facility use, individuals and groups requesting use of buildings must provide to the Borough Clerk a current certificate of comprehensive general liability insurance from an insurer licensed to do business in the State of New Jersey, with limits not less than $1,000,000 bodily injury/property damage combined single limit. The certificate of insurance must specifically name the Borough of Oceanport as an additional insured. Failure to provide a valid and acceptable certificate of insurance will void facility use. Users should check with their homeowner's insurance, which may cover this requirement.
As an alternative, the Borough has made available to users the ability to purchase a "tenant users liability insurance policy" (TULIP), which can be purchased for the specific date of use. The User is directly responsible for application and payment to the agency administering the TULIP program. Additional information on how to apply is available in the Borough Clerk's office.
