[Adopted 10-23-1989 by Ord. No. 89-2147 (Ch. 234, Art. V, of the 1996 Township Code)]
The Department of Public Works, Parks, and Engineering is hereby authorized to provide normal and routine road maintenance, snow removal and streetlighting services to residential condominium complexes within the Township, provided that the following requirements and conditions are met:
A. 
Condominium associations shall make application to the Department of Public Works, Parks, and Engineering, providing a proposed map of all streets to be subject to Township maintenance and snow removal and locating each streetlight. The Township Administrator, in consultation with the Director of Public Works, shall review each application and proposed map and determine if all roads shown on the submitted map are to be accepted or rejected; the final accepted map will delineate the extent of Township maintenance, snow removal and streetlighting.
B. 
The condominium associations shall continue their general liability insurance at amounts subject to the continuing approval of the Township and shall add the Township of Middletown as a named coinsured and furnish adequate proof of such insurance.
C. 
The condominium association shall execute a hold-harmless and indemnification agreement for the protection of the Township of Middletown, its agents and employees.
D. 
The Township Administrator may revoke any approval for these maintenance services upon 30 days' written notice for failure to comply with these requirements or for other proper reasons. The delineation of affected streets, location of streetlights and related matters shall be within the sole discretion of the Township.
This article and its requirements and conditions shall be applicable to presently existing residential condominium complexes and associations and any future residential condominium complexes or associations.
