(A) 
Pursuant to Ordinance No. 1-1998, approving the agreement between the City of Hometown and Chicago Title & Trust Company, Trust No. 53052 for the regulation of traffic and parking within the Hometown Shopping Center recorded February 23, 1998, as Document No. 98141082, the City agreed to establish and enforce the following regulations within the Hometown Shopping Center.
(B) 
The City hereby establishes and agrees to enforce the following regulations within the Center:
(1) 
Speed. The maximum speed limit for any vehicle shall be 15 miles per hour.
(2) 
Stop signs. Stop signs shall be posted at all exits and the driver of a vehicle emerging from the Center shall stop such vehicle immediately prior to driving onto a sidewalk or roadway and shall yield the right-of-way to any pedestrian as may be necessary to avoid collision and, upon entering the street or roadway, shall yield the right-of-way to all vehicles approaching on said street or roadway.
(3) 
Stopping, standing or parking. The stopping, standing or parking of any vehicle within the Center is prohibited in the following places:
(a) 
Fire lanes on the driveway or roadway which lies directly in front of the exit and entrance doors and immediate frontage (designated as "NO PARKING, FIRE LANE" zones by properly posted signs).
(b) 
On access driveways from the public street for ingress to and egress from the parking lot areas as designated "No Parking" zones by painted yellow curbs.
(c) 
Within 15 feet of a fire hydrant.
(d) 
Any area where prohibited by properly posted signs.
(e) 
In any areas when the motor vehicle constitutes an obstruction to traffic.
(f) 
Parking permitted only within lined stalls.
(g) 
Parking prohibited in reserved stalls, except for those permitted in said stalls, including but not limited to parking in handicapped designated stalls when not authorized.
(4) 
Abandoned vehicles. Any abandoned vehicle or inoperable vehicle as defined in Articles 19 and 20 of this Chapter 14, providing for the removal of abandoned or inoperable motor vehicles which are located within the Center, shall be subject to and governed by the provisions contained in said articles.
(5) 
Towing.
(a) 
The City may remove any vehicle parked, abandoned or found unattended in the parking area during snow storms, floods, fires or other public emergencies:
(i) 
When the vehicle constitutes an obstruction to traffic;
(ii) 
Where standing, stopping or parking is prohibited and proper tow-away zone or tow-away signs are posted;
(iii) 
Any vehicle committing a second violation of any provision, whether or not a tow-away sign is posted;
(iv) 
Any vehicle used or permitted to be used in violation of any law.
(b) 
The cost of towing and storage charge of a towed vehicle shall be paid the owner, lessor, lessee, agent of the auto before redemption;
(6) 
Lane usage. A vehicle shall remain in its properly designated lane of traffic, whether said lane is designated by striping, cones, or any other method designating the proper lane or channel for vehicular traffic within the parking area.
(7) 
Other laws. Enforce any law, rule or regulations, federal, state or ordinance, regulating traffic or the use of an automobile. All such laws regarding public highways or public lands shall be applicable. To that end, the provisions of the Illinois Vehicle Code, 625 ILCS 5/1-100 et seq., and Chapter 14, Traffic, of the Municipal Code of Hometown are incorporated into this agreement, and the ordinance authorizing the agreement, by reference.
(8) 
Signs. Signage shall conform with the Manual on Uniform Traffic Control Devices and the Illinois Vehicle Code.
(9) 
Penalty. Persons doing any act forbidden or failing to perform any act required by such parking or traffic regulations shall be guilty of a petty offense and subject to the penalty provisions of this Chapter 14 of the Municipal Code of Hometown, § 14.250.1, or any other penalty clauses contained in such chapter as are applicable to the nature of the offense. Furthermore, any citation issued for violations of Chapter 14 of the Municipal Code of Hometown pertaining to vehicular standing, parking and vehicle compliance violations shall be subject to the administrative adjudication process contained in Article 25 of this Chapter 14 of the Municipal Code of Hometown.
It shall be unlawful for any person to violate any of the provisions provided for in this article.
