This Part shall be known and may be cited as the "Lower Swatara Township Sewage Facilities Ordinance of 1971."

As used in this Part, the following terms shall have the meaning indicated:
COMMUNITY SEWERAGE SYSTEM
A sewage facility, whether publicly or privately owned, for the collection of sewage from two or more lots, or two or more equivalent dwelling units and the treatment or disposal, or both, of the sewage on one or more of the lots or at another site.
(1) 
COMMUNITY ON-LOT SEWAGE SYSTEMA system of piping, tanks or other facilities serving two or more lots and collecting, treating and disposing of sewage into a soil absorption area or retaining tank located on one or more of the lots or at another site.
(2) 
COMMUNITY SEWERAGE SYSTEMA publicly or privately owned community sewage system which uses a method of sewage collection, conveyance, treatment and disposal other than renovation in a soil absorption area, or retention in a retaining tank.
DEPARTMENT
The Department of Environmental Protection of the Commonwealth of Pennsylvania.
INDIVIDUAL SEWAGE SYSTEM
A system of piping, tanks or other facilities serving a single lot and collecting and disposing of sewage in whole or in part into the soil, into waters of this commonwealth or by means of conveyance to another site for final disposal. The term includes:
(1) 
INDIVIDUAL ON-LOT SEWAGE SYSTEMAn individual sewage system which uses a system of piping, tanks or other facilities for collecting, treating and disposing of sewage into a soil absorption area or spray field or by retention in a retaining tank.
(2) 
INDIVIDUAL SEWERAGE SYSTEMAn individual sewage system which uses a method of sewage collection, conveyance, treatment and disposal other than renovation in a soil absorption area, or retention in a retaining tank.
LOT
A part of a subdivision or a parcel of land used as a building site or intended to be used for building purposes, whether immediate or future, which would not be further subdivided. Whenever a lot is used for a multiple-family dwelling or for commercial, institutional or industrial purposes, the lot shall be deemed to have been subdivided into an equivalent number of single-family residential lots as determined by estimated sewage flows.
PERSON
Any individual, copartnership, association or private corporation.
RURAL RESIDENCE
A structure occupied or intended to be occupied by not more than two families on a tract of land of 10 acres or more.
SEWAGE
Any substance that contains any of the waste products or excrement or other discharge from the bodies of human beings or animals and any noxious or deleterious substances being harmful of inimical to the public health, or to animal or aquatic life or to the use of water for domestic water supply or for recreation.
TOWNSHIP
The Township of Lower Swatara, Dauphin County, Pennsylvania.

No person shall install an individual or community sewage disposal system or construct any building for which an individual or community sewage disposal system is to be installed without first obtaining a permit indicating that the site and the plans and specifications of such system are in compliance with the provisions of this Part and the standards adopted pursuant to this Part. No permit shall be required in those cases where a permit from the Department of Environmental Protection has been obtained. A permit shall be required for rural residences as well as all other residences.

No person shall reinstall or modify in any manner an existing individual or community sewage disposal system without first obtaining a permit.

Application for permit shall be in writing to the Township, and shall be made on a formal application blank and each application shall include such data as shall be prescribed by said technical standards for construction.

Permits shall be issued or denied within seven days after receiving an application for permit except that, in case the Township finds the data submitted by an applicant incomplete, the time for acting thereon shall be extended seven days beyond the date of submission of adequate supplementary or amendatory data. Denial of permit shall be supported by a statement in writing of the reasons for such action.

No system or structure designed to provide individual or community sewage disposal shall be covered from view until approval to cover the same has been given by the Township or its authorized representative. If 48 hours have elapsed, excepting Sundays and holidays, since the Township received notification of completion of construction, the applicant may cover said system or structure unless permission has been refused by the Township.

In case any permit is denied or revoked, a hearing will be held thereon before the Township within 15 days after request therefor is made by the applicant. Within seven days following the date of such hearing, the applicant shall be notified in writing of the determination of said hearing.

If the Township determines that any change has occurred in the physical conditions of any lands which will materially affect the operation of the community or individual sewage disposal system covered by any permit issued under this Part, the permit shall be revoked and a new permit shall be obtained before construction shall proceed.

The Township shall have the power to make, or cause to be made, such inspections and tests as may be necessary to carry out the provisions of this Part and its authorized representatives shall have the right to enter upon lands for said purposes.

Every applicant for a permit under this Part shall pay to the Township, at the time of the filing of the application, such fee as the Township may from time to time prescribe, which fee shall be applied toward the cost of administration of this Part.

The Township hereby adopts the standards of the Department of Environmental Protection of Pennsylvania relative to the installation of individual and community sewage disposal systems as the standards to be applied to any application for permit under this Part, whether said standards have been adopted by the Department or shall in the future be adopted by the Department.

Any person, firm or corporation who shall violate any provision of this Part or the rules, regulations or standards promulgated thereunder or who resists or interferes with any officer, agent or employee of the Township, in accordance with the provisions of this Part, in the performance of his duties, shall, upon conviction thereof, be sentenced to pay a fine of not less than $300 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to imprisonment for a term not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.

In addition to any other remedies under this Part, the Township may institute in the Court of Common Pleas of Dauphin County, Pennsylvania, proceedings to restrain violations of the provisions of this Part.
