The following words, terms and phrases, when used in this division,
shall have the meanings ascribed to them in this section, except where
the context clearly indicates a different meaning:
PEDDLER/SOLICITOR
Any person peddling by foot, wagon, automotive vehicle or
other conveyance, either stationary or place to place, or from street
to street, carrying, conveying or transporting goods, wares, merchandise,
meats, fish, vegetables, fruits, garden truck, farm products or provisions,
offering and exposing them for sale or making sales and delivering
articles to purchasers. Any person who solicits orders and as a separate
transaction makes deliveries to purchasers shall be deemed a peddler/solicitor.
The word "peddler" shall include the words "hawker" and "huckster."

No person shall engage in the business of peddler/solicitor
without first obtaining a license therefor. No such license shall
be granted except upon certification of the Chief of Police or his
or her designee. No such license shall be waived unless passed by
resolution of the City Council.

No peddler/solicitor shall stop or remain in any one place upon any street, alley or public place to make a sale with a maximum time allowance of longer than 1/2 hour. Any peddler using a vehicle, when stopped, shall place his vehicle parallel to and within 12 inches of the curb and shall depart from such place as soon as he has completed sales with customers actually present. Such provisions of this section may be waived or altered by City Council resolution as provided for under §
18-168 of this Code.

No peddler, in the sale of goods, wares and merchandise, shall
obstruct any street, alley, sidewalk or driveway except as may be
necessary and reasonable to consummate a sale. No peddler shall engage
in peddling on any street, alley or public place after having been
requested to desist by any police officer of the City because of congested
or dangerous traffic conditions.

No peddler/solicitor shall shout or call out his wares, or use
any horn or bell or other noise-making device to call attention to
his wares, in a loud, hoarse or noisy manner, creating a disturbance
to the citizens and dwellers within the City.

No person shall operate or maintain any stand, vehicle, store or place of business on or near to any highway in such a manner that the customers of or traders with such person occupy or congregate within the limits of any street, lane, highway or public place within the City. No person shall be permitted to use the streets, alleys, lanes or public places of the City for the service of customers or for the transaction of business, or to use any stands, stores or other places of business in any manner that shall require the customer, when transacting business, to stand within the limits of the streets, highways, alleys or public places of the City except as provided for in §
18-168 of this Code.

The following shall be exempt from the licensing requirements
of this article but shall be subject to the other provisions of this
article: any person under 18 years of age, when engaged in peddling
under the direct supervision of any school or recognized charitable
or religious organization.

(a) The City Council, in its sole discretion and by resolution,
may, under special events and circumstances, exempt or alter any of
the requirements of this article within the limits of any street,
lane, highway or public place within the City.
(b) Special events or occasions as they pertain to Recreation/Conservation
zoned land in the City shall be regulated by the City Manager.

The fees for a solicitor's license shall be as specified in Chapter
38 of this Code and exempted or altered under the provisions of §
18-191.

Persons under 18 years of age, when engaged in soliciting under

organization, shall be exempt from the requirements of this article.
