There is hereby established a recycling program for the mandatory
separating of newspapers from refuse including garbage, trash and
rubbish in the Township of Thornbury.

For the purpose of this article, newspapers shall be deemed
to be that material commonly known as "newsprint," on which is printed
news, opinions and advertisements and which is distributed at stated
intervals, usually daily or weekly. Magazines shall not be considered
newspapers for the purpose of this article.

Newspapers shall be kept separate from other refuse and shall
be collected by the Township or under contract or subcontract by its
designated agent. Individual household units shall separate and prepare
newspapers for collection in the following manner: Newspapers shall
be tied both across and lengthwise in manageable bundles or placed
in paper bags and kept dry. These materials shall be placed either
at the curbside to be collected at times designated by the Township
or placed in recycling shelters at any time. It shall be unlawful
for any person to deposit for collection, removal or disposal solid
waste which contains newspaper combined with other forms of solid
waste.

From the time of placement of newspapers at the curb or in recycling
shelters for collection in accordance with the provisions hereof,
such newspaper shall be the property of Thornbury Township or its
designated agent. It shall be a violation of this article for any
unauthorized person to collect or cause to be collected any such newspapers
and it shall be a violation for any person to collect, remove or dispose
of solid waste which visibly and in plain view combines newspaper
with other forms of solid waste.

Any person, firm or corporation who shall violate any provision
of this article, upon conviction thereof in an action brought before
a District Justice in the manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not more than $1,000 plus costs and,
in default of payment of said fine and cost, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this article continues
or each section of this article which shall be found to have been
violated shall constitute a separate offense.

Nothing in this chapter shall be construed to prevent or penalize
or otherwise make illegal the donation or sale of refuse newspaper
to any person, partnership, corporation or charitable entity provided,
however, that such donated or sold refuse newspaper shall be placed
at curbside for pickup by the donee or vendee.
