As used in this Part 1, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
BURNING
The tending, causing to ignite or igniting of any material to cause flame, smoke, embers, hot ash or residue, in combination or individually.
NON-BURNABLE MATERIALS

(1) 
Plastic, rubber, oils, asbestos, composition board, shingles, felt paper, canvas, fiberglass, vinyl or any similar materials.
(2) 
Human or animal waste, sanitary napkins, diapers, food solids, oil filters, or any other materials that emit smoke or acrid, obnoxious or toxic odors.
(3) 
Grasses, green twigs, leaves, leaf waste, wood chippings, branches, or limbs.
(4) 
Any wood that has been chemically treated to prevent rot or moisture damage or other similar treatment, wood products that have high glue content such as flake board or composition board and wood products in combination with any non-burnable material.
(5) 
Any other materials that do not comply fully with the intent of this Part 1, or otherwise create a nuisance to people or animals.
(6) 
Any material collected for recycling.
RECREATIONAL BURNING
For the purposes of this Part 1, the following shall be deemed to be recreational burning:
(1) 
OUTDOOR GRILLAny device manufactured, designed and built for the express purpose of cooking food out of doors.
(a) 
FUELOutdoor grills may be fueled only by LP or natural gas, charcoal briquettes, or wood.

WOODIncludes any unpainted wood or wood product.
(b) 
CHIMINEAA small outdoor fireplace usually made of clay, terra cotta or metal, fueled only by wood, charcoal briquettes or LP/natural gas and must be screened to prevent flying embers and hot ash.
(c) 
OUTDOOR FIREPLACEA place for building fires outside of the home. Similar in construction to an indoor fireplace, usually added to a stone, brick, or concrete patio, consisting of a firebox and a chimney usually used for cooking. An outdoor fireplace may be a decorative element, allowing homeowners to enjoy a crackling fire while entertaining in the backyard. Outdoor fireplaces shall be fueled only by wood, charcoal briquettes or natural/LP gas and must be screened to prevent flying embers and hot ash.

The Police Department of the Borough of Hummelstown shall have the power and duty to enforce the provisions of this Part 1.

1. 
All burning within the geographical limits of the Borough of Hummelstown is prohibited, except as set forth hereinafter:
A. 
Exceptions.
(1) 
Recreational Burning.
(a) 
May be conducted only between the hours of sunrise and 11:00 p.m.
(b) 
Must be attended at all times by an individual of not less than 14 years of age.
(c) 
Must be at lest 10 feet from all property lines and/or structures.
(2) 
A fire burned under the direct control of a recognized volunteer or paid fire company shall be permitted if necessary for:
(a) 
The prevention of a fire hazard which cannot be abated by other means.
(b) 
The protection of public health.
(3) 
Other exceptions may be granted by the Borough Council when petitioned and shall be granted when the circumstances reasonably require outside burning, and do not present a hazard or annoyance to persons or property. No such burning shall be performed until after the granting of a waiver of this Part 1.

Any person who violates any provision of this Part 1 shall, upon conviction, be sentenced to pay a fine of not less than $100 nor more than $600 and/or to imprisonment to the extent allowed by law for summary offenses.
