Any person who shall construct a driveway into the right of
way of a public street abutting that person's property is required
to apply for a permit prior to the commencement of construction from
the Township Building Inspector. The permit fee shall be in an amount
as established, from time to time, by resolution of the Board of Supervisors,
payable upon issuance of the permit.

Any concrete driveway built into the right-of-way of a public
street shall be constructed with a joint at the right of way line
between the street and the abutting property from which the driveway
extends. Additional joints shall be constructed not more than every
six feet apart, to the extent that the concrete driveway is within
the right-of-way of the street. Any driveway constructed in the right-of-way
must be constructed so as not to disturb water flow or snow removal.
All curb cuts shall be made in accordance with plans filed, and said
plans must include restoration procedures.

1. As used in this Part, the following words shall have the meanings
set forth below unless clearly indicated otherwise:
CURB CUTTING
Cutting of any curb or pavement adjacent to the cartway.
JOINT
A definite separation between adjacent concrete slabs.

The forms for any driveway or the excavation or paving of any
driveway built into the right of way of a public street shall be inspected
by the Township Building Inspector and found to be in compliance with
the constructional specifications of this Part by the Building Inspector
before the permit will be issued. The person constructing the driveway
may begin to pour concrete, pave or excavate only after obtaining
the permit.

Any person who violates any provision of this Part, upon conviction
thereof in an action brought before a magisterial district judge in
the manner provided for the enforcement of summary offenses under
the Pennsylvania Rules of Criminal Procedure, shall be sentenced to
pay a fine of not more than $1,000 plus costs and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 90
days. Each day that a violation of this Part continues or each section
of this Part which shall be found to have been violated shall constitute
a separate offense.
