Any person found to be violating any provision of this chapter
shall be served by the Town with written notice stating the nature
of the violation and providing a reasonable time limit for the satisfactory
correction thereof. The offender shall, within the period of time
stated in such notice, permanently cease all violations.
A violation of any section of this chapter shall constitute
a "violation" as defined in the Penal Law of the State of New York
and shall be punishable by a fine not exceeding $250 or by a sentence
of imprisonment not exceeding 15 days, or by both fine and imprisonment.
Each day in which any such violation shall continue shall be deemed
a separate offense.
The malicious, willful or negligent breaking, damaging, destruction,
uncovering, defacing or tampering with any structure, appurtenance
or equipment which is part of this sewage works shall be a violation
of this chapter, and any person violating this section shall be subject
to the fines herein provided and shall be liable for any damage or
loss suffered by the District or Town.
Any person violating any provision of this chapter shall be
responsible in money damages for any injury to the sewer system or
expenses caused the District by such violation. This money may be
collected by civil action in any court of competent jurisdiction.
Obedience to this chapter may also be enforced by injunction.
The Town shall adopt rules and regulations as necessary to manage
and operate the sewage collection system. The Town, after initial
adoption of said rules and regulations, shall have the right to modify
same as it deems necessary by subsequent resolution of the Town.
