The Police Department is authorized to designate as play highways, whenever he deems that action advisable and for whatever period of time directed by him, any part of any street in the Borough of Wellsboro where sledding and coasting shall be permitted. That play highway shall be set apart for the purpose under the direction of the Police Department.
3. 
No person shall drive any motor vehicle upon any play highway at any time when that street shall be designated as a play highway, except in case of emergency, with special permission of the Police Department or of the police officer in charge, who shall first clear that play highway of all persons using it for the purpose for which it was set aside. Any person who violates any provision of this subsection shall, upon conviction, be sentenced to pay a fine of $25 and costs.

1. 
Generally.
A. 
No person shall operate a snowmobile upon any street, alleys, lane or public way within the Borough of Wellsboro other than to drive across it and then only after stopping and yielding the right-of-way to all vehicles approaching on the street, lane, alley or highway.
B. 
A snowmobile may make a direct crossing of a street or two lane highway provided:
(1) 
A crossing is made at an angle of approximately 90° to the direction of the highway and at a place where no obstruction prevents a quick and safe crossing.
(2) 
The snowmobile is brought to a complete stop before crossing a shoulder or main traveled portion of said street, alley, lane or highway.
(3) 
The driver yields the right-of-way to all oncoming traffic which constitutes an immediate hazard.
(4) 
In crossing a divided street, alley, lane or highway, the crossing is made at an intersection of such highway with another public street or highway.
C. 
Except as otherwise provided by action of the Borough Council of the Borough of Wellsboro, through its Borough Manager or other designated officer, it shall be unlawful to operate a snowmobile on any street, alley or lane or highway within the borough of Wellsboro which is not designated and posted as a snowmobile road by the Borough of Wellsboro.
D. 
Snowmobiles may be operated on highways, streets, alleys and lane of the Borough of Wellsboro during period of emergency when so declared by a federal, state, county or Wellsboro Borough official having jurisdiction.
E. 
Snowmobiles may be operated on streets, highways, alleys and lanes of the Borough of Wellsboro when necessary to cross a bridge or culvert.
F. 
Snowmobiles may be operated on highways, streets, alleys and lanes for the Borough for special snowmobile events of limited duration which are conducted according to a prearranged schedule under permit from the Borough of Wellsboro.
2. 
Snowmobile Races, Rallies or Derbies.
A. 
The Borough of Wellsboro may, from time to time, block off streets of the Borough for the purpose of allowing snowmobile races, rallies or derbies, but the Borough shall not be responsible for any injury suffered by anyone in connection with, or arising out of any such race, rally or derby. No state trunk highway or connecting street or part thereof shall be blocked off by the borough for any snowmobile race, rally or derby.
B. 
Application for such a race, rally or derby must be made to the Borough Manager of the Borough of Wellsboro or his representative and he shall notify the local police department and the Tioga County Sheriff's Office at least one week in advance of the time and place of any snowmobile race, rally or derby which may result in any street or part thereof of the Borough of Wellsboro being block off. Upon such notice, the Borough Police Department shall take such measures as is deemed appropriate to protect persons and property and to regulate traffic in the designated area of the vicinity on the day of such a race or derby.
3. 
Age Limit for Snowmobile Operator.
A. 
No person under the age of 16 shall drive a snowmobile across any highway, street, alley or lane of the Borough of Wellsboro or connecting street thereto.
B. 
No person under the age of 10 years shall operate a snowmobile within the Borough of Wellsboro without the knowledge and express consent of the landowner unless he is accompanied by a person over 18 years of age or a person over 14 years of age who holds a snowmobile safety certificate.
C. 
On or before February 1, 1972, no person 10 years and over who has not reached his 16th birthday shall operate a snowmobile within the Borough of Wellsboro, except upon the lands of his parent or guardian unless and until he has received safety training as prescribed by the appropriate state department and has received an appropriate snowmobile safety certificate issued by the Secretary.
D. 
The failure of such youthful operator to exhibit a snowmobile safety certificate upon demand to any police officer having authority to enforce the provisions of this section shall be presumptive evidence that such person is not the holder of such certificate.
E. 
After February 1, 1972, no owner of a snowmobile shall authorize or permit the operation thereof within the Borough of Wellsboro by any person under the age of 16 years unless the operator is the holder of a valid snowmobile safety certificate or except as otherwise authorized in this section.
4. 
Accident Reports. The operator of a snowmobile involved in an accident resulting in injuries to or death of any person or property damage to the estimated amount of $100 or more shall make such accident report as may be required by law.
5. 
Liability for Negligence. Negligence in the use or operation of a snowmobile is attributable to the owner. Every owner of a snowmobile used or operated in this Borough shall be liable and responsible for death or injury to person or damage to property resulting from the negligence in use or operation of such snowmobile by any person using or operating the same with the permission, express or implied, of such owner; provided, however, that such operator's negligence shall not be attributed to the owner as to any claim or cause of action occurring to the operator or his legal representative for injuries or death.
6. 
No person shall drive or pursue any wildlife through the Borough of Wellsboro with a snowmobile.
7. 
No owner or other person having charge or control of a snowmobile shall knowingly authorize or permit any person to operate such snowmobile, who is incapable, by reason of age, physical or mental disability or who is under the influence of intoxicating liquor, fermented malt beverages, narcotics or other drugs.
8. 
A snowmobile shall be operated in hours of darkness with head lamps and tail lamps as required by state law. Snowmobiles shall not be operated within the Borough between 1:00 a.m. and 6:00 a.m. except under emergency conditions.
9. 
It shall be unlawful to operate a snowmobile which is not equipped with at least one brake as required by state law.
10. 
Mufflers. It shall be unlawful to operate a snowmobile within the Borough of Wellsboro which is not equipped at all times with a muffler in good working order which blends the exhaust noise into the overall snowmobile noise and is in constant operation to prevent excessive or unusual noise. The exhaust system shall not emit or produce a sharp popping or crackling sound. This section will not apply to organized races or similar competitive events.
11. 
No person shall operate a snowmobile in any of the following ways:
A. 
At a rate of speed that is unreasonable or improper under existing conditions.
B. 
In any careless way so as to endanger the person or property of another.
C. 
While under the influence of intoxicating liquor, fermented malt beverages, narcotics or other drugs.
D. 
On private property, without the consent of the owner or of the lessor thereof. Any person operating a snowmobile on lands of another shall stop and identify himself upon the request of the landowner, tenant or his duly authorized representative and, if requested to do so by the said landowner, shall promptly remove said snowmobile from the premises.
12. 
Enforcement.
A. 
Members of the Wellsboro Police Department and designated officer and employees of the Borough shall enforce this Part.
B. 
The Chief of Police shall prepared or cause to be prepared such records and reports as may be prescribed hereunder.
C. 
Any person who disposes of any snowmobile summons and/or complaint in any other manner than that prescribed by law, rules or regulation shall be guilty of a misdemeanor.
13. 
Collection of Penalties. Any action to recover any penalty imposed under the provision of general state law or this Part may be brought in any court of competent jurisdiction in this state.
14. 
Penalty. Any person who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not less than $10 or more than $50 plus costs, for the first offense; and, for a second offense be sentenced to pay a fine not less than $25 nor more than $100 plus costs; and, for subsequent offenses, be sentenced to pay a fine of not more than $600 plus costs and, in default of payment of said fine and costs, to imprisonment for a term not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
15. 
The words "alley" and "lane" are hereby defined to include sidewalks within this Borough.
16. 
The Borough Council may, from time to time, designate certain highways and streets as snowmobile access routes for purposes of ingress and egress from the Borough; provided, however, that no such use of access routes shall be in violation of the Act of August 12, 1971, Act No. 75, or amendments thereto.
