It is unlawful for any owner, occupant or user of any premises to direct into or allow any stormwater, surface water or groundwater to drain into the wastewater collection system. No roof downspouts or other form of surface drainage and no foundation drainage or sump pump shall be connected or discharged into any wastewater collection system.

A discharge pipe shall be installed through the outside foundation wall of the building with rigid pipe without valves or quick connections that would alter the path of discharge. The discharge shall be directed away from the foundation wall.

No discharge shall be directed so as to impact neighboring properties.

Subject to constitutional provisions, property owners shall allow Borough of Wellsboro employees or a designated representative to inspect the buildings to confirm that there is no prohibited discharge into the wastewater collection system. The Borough may periodically reinspect any building or premises to determine compliance with the requirements of this Part. For the purpose of enforcing this Part, the Borough Officer or its designee may, at its discretion, seek to obtain a search warrant issued by a competent authority for the purpose of compelling an inspection of a residential unit.

1. 
A surcharge is hereby imposed on every sewer bill to property owners for the following conditions:

Floor drain(s) connected to the wastewater collection system
1 EDU
Foundation drain(s) connected to the wastewater collection system

Each customer must have their property inspected by the deadline established for their section of the Borough to confirm compliance with this Part. If a customer either refuses to allow an inspection or does not respond to a request to inspect, the sewer billing for that customer will be based upon having a sump pump, roof leader, floor drain and foundation drain connected along with the standard billing for the respective customer.

A surcharge equal to three times the sewer rate, as identified in the Borough's provisions related to sewer rates, is hereby imposed and added to every sewer billing to property owners who are not in compliance with this Part, 60 days after noncompliance is identified. The surcharge shall be added every month until the property is in compliance. The Borough Council may grant waivers from the surcharge where strict enforcement may cause undue hardship unique to the property or where the property owner was scheduled for disconnection or improvement, but cannot do so due to circumstances such as availability of the plumber or inclement weather.
