The following portion of the Borough of Wellsboro is hereby defined as a district in which all electric light, electric power, telephone, telegraph, television and other forms of wires shall be placed underground in conduits:
All that portion of the Borough of Wellsboro bounded as follows: From the southern edge of the intersection of Main Street with Queen Street for the entire width of Main Street to the northern edge of the intersection of Main Street with Charles Street.

All electric light, electric power, telephone, telegraph, television and other forms of wires for the conveyance of electricity for any purpose in the district defined in § 21-501 shall be placed underground. No poles or supports therefor shall be allowed to remain or be on any of the streets or sidewalks in such district; provided, terminal poles and devices may be erected and maintained within the limits of each block within such district by every such company connecting therewith, and overhead cables and wires may be distributed from such terminal poles to such places within such blocks as consumers and patrons may require; but no overhead cable or wire shall be constructed or maintained between a terminal pole or device in one block and any such terminal pole or device in another block.

All wires, cables, conduits, tubes, subways and other parts of any underground system of any person, firm or corporation on any of the streets or alleys in the Borough of Wellsboro shall be not less than two feet beneath the surface thereof, and shall be laid in alleys along said route as far as practicable. Not more than two squares of any street shall be opened or the pavement thereof disturbed at any one time for the construction or repairing of any underground system. Every person, firm or corporation who or which shall remove or take up, displace or disturb any portion of the pavement of any street shall promptly renew or replace the said portion in as good condition as the same was before the work was commenced, under the supervision and direction of the Borough Manager and subject to the approval of the Council.

The Borough shall at all times have the right and power to place, use, control and operate one duct of each underground conduit or subway for such wires, cables, devices and apparatus as may be necessary for the use of the Borough for fire alarm and police communications systems. Such ducts shall be furnished by the person, firm or corporation operating such underground conduit or subway, shall be placed at the bottom of such conduit or subway and shall have the word "Borough" inscribed thereon. Should the wires of any person, firm or corporation interfere with the proper services of any Borough wires, such person, firm or corporation shall at once, upon notice in writing from the Borough, make such necessary changes as will avoid and eliminate all such interference.

Every person, firm or corporation maintaining any underground conduit within the Borough of Wellsboro, at least once in every week, thoroughly pump out such conduit for the purposes of removing any gas or water that may have collected therein.

All existing poles and overhead wires, within the district defined in § 21-501 of this Part shall be removed within one year after the date of approval of this Part. No poles or wires shall be constructed or placed in violation of any of provisions of this Part at any time after the approval of this Part.

Any person, firm or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not more $1,000 plus costs and, in default of payment of said fine and costs, to imprisonment for a term not to exceed 30 days. Each day a violation of this Part continues shall constitute a separate offense.
