This Subpart is enacted pursuant to the authority conferred by the Vehicle Code, Act of 1976, June 17, P.L. 1962, No. 81, Section 1, effective July 1, 1977 (75 Pa.C.S.A. § 101 et seq.), as amended, and is intended to include and be subject to all provisions of Section 4902 of the Vehicle Code (75 Pa.C.S.A. § 4902) and all Pennsylvania Department of Transportation regulations promulgated or to be promulgated under the Vehicle Code, by way of illustration and not limitation, under Sections 4902 and 6103 [75 Pa.C.S.A. § 4902(f) and 6103].

No motor vehicle or combination (as those terms are defined in 75 Pa.C.S.A. § 102) having a gross weight (as that term is defined in 75 Pa.C.S.A. § 102) in excess of 20 tons shall be operated upon the two culverts which cross beneath Berry Hollow Road (T-680), the first culvert being located beneath Berry Hollow Road at a point 0.3 miles east of the intersection of Berry Hollow Road and North Delaware Drive (S.R. 0611) and the second culvert being located beneath Berry Hollow Road at a point 1.4 miles west of the intersection of Berry Hollow Road and Richmond Road (S.R. 1017), as recommended by the report, due to the existing condition of the culverts.

The Township shall erect and maintain, or cause to be erected and maintained, signs designating the weight restriction stated in § 15-623 of this Subpart. Signs shall be placed within 25 feet of each culvert identified in § 15-623. A sign shall be placed for each lane of traffic crossing the culverts. Additionally, signs designating the restriction shall be placed on Berry Hollow Road at said road's intersections with North Delaware Drive (S.R. 0611) and Richmond Road (S.R. 1017).

Pursuant to the authority granted by 75 Pa.C.S.A. § 4902(g), any person operating a motor vehicle or combination upon the restricted culverts in violation of § 15-623 of this Subpart is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $150, plus an additional $150 for each 500 pounds, or part thereof, in excess of 3,000 pounds over the maximum allowable weight.
