The State Energy Conservation Construction Code has been promulgated by the State Energy Office pursuant to Article 11 of the Energy Law. The code applies to all new public and private buildings and construction of any addition, alteration or renovation of an existing building which materially increases the heating and/or cooling requirements of such a building. This code has been promulgated as regulations of the Energy Office in Title 9 of the New York Codes, Rules and Regulations, Parts 7810 through 7815. In the City of Plattsburgh, New York, the New York State Energy Conservation Construction Code is hereby modified by this chapter to make the use of the automatic setback thermostat or an automatic central setback controller connected to individual zone thermostats mandatory rather than optional.
To ensure compliance with the New York State Energy Conservation Construction Code, the following procedures will be observed:
A. 
Building permit applications for all new building construction or for any addition, alteration or renovation of any existing building which materially changes its heating or cooling requirements and which include plans for electric heating or cooling shall include the following data:
(1) 
Heat load calculations for the new building or portions of the altered existing building to be heated electrically.
(2) 
For commercial buildings, combined thermal heat transmission calculations utilizing Equation 1 (included as an attachment to this chapter) for the new building or portions of the altered existing building to be heated electrically, or compliance with Part 5 of the Energy Conservation Code for residential buildings.
(3) 
Plans and/or specifications for the new building or of the addition to, alteration or renovation of the existing building in sufficient detail to document full compliance with the requirements of the construction standards of the New York State Energy Conservation Construction Code.
(4) 
Plans and/or specifications for the new building or of the addition to alteration or renovating of any existing building utilizing electric heating or cooling shall have at least one heating/cooling zone per floor controlled by a separate automatic setback thermostat for each zone or an automatic central setback controller connected to the individual zone thermostats.
B. 
Inspections of the building will be made by an authorized representative of the City at appropriate times during the work period to inspect the work in progress. The owner of the building shall notify the Building Inspector when the building is ready for inspection. At least 24 hours' advance notice shall be given when requesting inspection.
C. 
Prior to connection of electrical service for heating, the Municipal Lighting Department will require a certificate of compliance stating that the construction standards of the New York State Energy Conservation Construction Code have been met. The certificate of compliance shall be signed by the contractor, owner and Building Inspector. The certificate of compliance for provision of electric service to buildings subject to the New York Energy Conservation Construction Code is included at the end of this chapter.
In unusual circumstances, when the application of these standards appears impractical or inequitable, the City will refer the matter to the Power Authority for special ruling or for the approval of special conditions which may be mutually agreed upon. The applicant will submit, along with the request for special ruling or for the approval of special conditions, a copy of any energy audit performed on the building by a registered architect or professional engineer.
Any violation of this chapter, as determined by the Building Inspector, will result in the denial or disconnection of electric service to the building or mobile home that is in violation.
