All owners of real estate in the Borough of Clayton shall keep the same free and clear of all noxious weeds and other unhealthy vegetable growth at all times.
In the event that any noxious or unhealthy vegetable growth is permitted to remain and exist upon any real estate in the Borough of Clayton, the Borough of Clayton shall give written notice of such condition to the owner of such real estate, notifying such person that, if the same shall not be cut down and removed within 10 days from the date of said notice, then and in such case the Borough of Clayton shall cause the same to be cut down and removed at the expense of the owner or owners of such real estate. Such notice shall be mailed by the Borough of Clayton, with postage prepaid thereon, to the respective post office address of such owner, if the same can be ascertained, and, if not, such notice shall be posted upon the premises.
Any person or corporation violating any of the provisions of this article shall, upon conviction thereof, be subject to a fine of not more than $200 or imprisonment for a term not to exceed 30 days, or both. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such. The penalty provided by this section is in addition to the liability of the owner to pay for the cost of removal by the Borough in the event that such removal by the Borough occurs.
