Freezing precipitation shall mean precipitation falling in the form of freezing drizzle, freezing rain, sleet, hail, ice crystals, ice pellets, snow, snow pellets or snow grains.
Following the effective date of this article, it shall be unlawful to abandon, park or allow to be parked any motor vehicle or any other vehicle on any public highway, street or road which is part of the Township road system, during periods of freezing precipitation until the freezing precipitation has stopped and the public highway, road or street has been completely plowed and/or treated for its full width.
The Lancaster Township Police Department is hereby authorized to ticket, impound and remove to a designated impound lot any vehicle abandoned or parked upon any public highway, street or road in violation of this article. The Police Department shall promptly notify the registered owner of any impounded vehicle, in writing, of the removal, the location and telephone number of the impound lot where the car is stored and any and all towing and storage charges which must be paid to the lot owner prior to the vehicle being released.
Neither the Township or any of its employees shall be responsible for any damage to any vehicle occurring as a result of impounding, removing, towing, or storage of a vehicle abandoned or parked in violation of this article.
Any person violating any provision of this article or any amendment thereto shall, upon conviction thereof in a summary offense proceeding before a Magisterial District Judge, pay a criminal fine of not more than $50 per violation, plus all court costs and reasonable attorney fees incurred by the Township in the enforcement proceedings. All fines, costs and fees collected shall be paid over to the Township treasurer.
