There is hereby imposed an annual sewer rental or charge for the use of the Borough sewer system and cost of operation, to be payable by the owners of all properties served by any of the sewers of the Borough.

1. 
There is hereby imposed an annual sewer rental or charge for the use of the sewers, sewage system and treatment of sewage upon the owners of property served thereby at the rates hereinafter set forth:
A. 
Residential Users. The sewer rental or charge hereby imposed shall be at the rate of $394 per annum, payable in quarterly installments in the amount of $98.50 on February 5, May 5, August 5 and November 5.

(1) 
If the annual rental or charge for a residential unit is paid in its entirety by the first quarter due date, there shall be a 5% reduction in the total annual fee. The payment shall be $374.30.
(2) 
If a residential property is vacant for six months or longer, the property owner shall petition the Borough for relief of charges or rentals. The Borough will award relief in the amount of $8.64 per quarter of vacancy.
B. 
Business Users. The sewer rental hereby imposed shall be a quarterly charge and assessment, payable in quarterly installments February 5, May 5, August 5 and November 5. The quarterly charge will be $99 per quarter, plus an assessment of $8 per thousand cubic feet, for the first 10,000 cubic feet of water consumption as measured by the City of Erie for the previous quarter and $10 per thousand cubic feet for all additional amounts.

C. 
Mobile Home Parks. The sewer rental hereby imposed shall be at the rate of $394 per annum per unit, payable in quarterly installments in the amount of $98.50 on February 5, May 5, August 5 and November 5. The rental shall be assessed to the owner of the mobile home park, who shall be responsible for payment of the assessment.
D. 
Multi-Users. Any individual, corporation, partnership or other entity that has any form of business, either incorporated or unincorporated, in the same facility as one or more dwelling units shall be considered as a multi-user, and the sewer rental hereby imposed shall be as for the business owner, and, in addition, a $24 per dwelling unit charge shall be imposed on the owner of the properties served.

Council of the Borough of Wesleyville shall cause notice of the amount of the sewer rental or charge to be given the owners of all properties served by the sewers of the Borough quarterly. All sewer rentals or charges remaining unpaid on the first day of the month following the month when the sewer rental or charge is due and payable as provided in § 18-202 shall be considered delinquent, and 1 1/2% per month shall be added hereto. The amount of the sewer rental or charge so arrived at shall be a lien upon the property charged with the payment thereof. Any delinquent or unpaid sewer rental or charge may be collected as provided by law by an action of assumpsit, by lien filed in the nature of municipal lien and/or by terminating water service at the property owner's expense. The Borough Secretary is hereby charged with the administration of this Part and is authorized to deliver to the Borough Solicitor from time to time a list of all unpaid sewer rentals, and said solicitor is authorized to proceed for the collection of the same as herein provided. The Borough Secretary may also pursue termination of water services.

All monies received from the sewer rental or charges authorized by this Part shall be deposited in the Sewer Rental Fund and withdrawals shall be made upon such account for all lawful purposes.

All sewer rentals or charges remaining unpaid on the first day of the month following the month when sewer rental or charge is due and payable shall be delinquent, and 1 1/2% per month shall be added hereto. All those sewer rental or charges remaining unpaid for two quarters may be collected as provided by law by an action of assumpsit, by lien filed in the nature of municipal lien and/or by terminating water service at the property owner's expense.
