As used in this Part, the following words and terms shall have the meanings indicated:
ABANDONED VEHICLE
A vehicle (other than a pedalcycle) to which any of the following apply:
(1) 
The vehicle is physically inoperable and has been left unattended on a highway, street, alley or other public property of the Township of Valley for more than 48 hours.
(2) 
The vehicle has remained illegally on a highway, street, alley or other public property of the Township of Valley for more than 48 hours.
(3) 
The vehicle has been left unattended on or along a highway, street, alley or other public property of the Township of Valley for more than 48 hours and does not bear all of the following:
(a) 
A valid registration plate.
(b) 
A certificate of inspection.
(c) 
An ascertainable vehicle identification number.
(4) 
The vehicle has remained on private property without the consent of the owner or person in control of the property for more than 48 hours, provided that no vehicle used, or to be used, in construction or in the operation or maintenance of highways or public utility facilities, which are left in a manner which does not interfere with the normal movement of traffic, shall not be considered to be abandoned.
GARBAGE
All refuse, offal, dead animals, decaying matter or organic waste substance of any kind.
RUBBISH
Any ashes, waste, paper, wooden or cardboard boxes, cartons, bottles, cans, barrels or other waste or discarded materials.
WRECKED OR JUNKED AUTOMOBILE
A vehicle (other than a pedalcycle) that has remained on or along a highway, street, alley or other public property of the Township of Valley, or upon any private property within the Township of Valley for more than 48 hours and does not comply with the current vehicle equipment standard(s) as promulgated by the Department of Transportation of the Commonwealth of Pennsylvania.

It shall be unlawful for any person, persons, firm or corporation to dump, cast, throw, discharge, keep, suffer to remain or cause or permit to accumulate on any highway, street or alley or any public property of the Township of Valley any garbage or rubbish.

It shall be unlawful for any person, persons, firm or corporation to allow to remain or cause to permit to accumulate upon any private property within the Township of Valley owned, supervised or controlled by that or any other person, persons, firm or corporation any garbage or rubbish.

It shall be unlawful for any person, persons, firm or corporation to dump, store or maintain any abandoned, wrecked, junked automobile or the striped chassis or body of an automobile upon any private property within the Township of Valley except for the purpose of the immediate dismantling thereof for parts or the restoration thereof for operation; and in the event of such storage or maintenance for the purposes of either dismantling or restoration, no chassis or body of an automobile, stripped or whole, shall be permitted to remain in an unregistered status with the Commonwealth of Pennsylvania, Department of Transportation, upon any premises for a period in excess of 30 days. Provided, this section shall not include the storage or maintenance of any abandoned, wrecked or junked automobile or the stripped chassis or body of an automobile in a commercial district in connection with an automobile repair business where the stripped chassis or body of an automobile are merely awaiting the repair or disposal thereof in the immediate future.
A. 
The movement about of such vehicle(s), chassis or part(s) thereof on or about the premises or property or area adjacent or near thereto, within such thirty-day period, shall not act to circumvent the purpose and intent of this Part, which is to prevent the storage of such vehicle(s) or part(s) thereof for a period in excess of 30 days. Likewise, the removal of such vehicle(s), as aforesaid, from the premises with the intent to replace the same on such premises or adjacent property shall not act to circumvent the intent of this Part and any vehicle(s), as aforesaid, so removed, if returned or replaced on such premises or property within a period of 45 days after such removal, shall be construed to have been stored continuously on the premises for such period of removal, unless the vehicle is returned with a valid, current inspection sticker affixed to the windshield in accordance with the applicable provisions of the Pennsylvania Vehicle Code or similar statutes of other states, where applicable, or in such condition as to qualify as an antique or racing vehicle as hereinafter provided.
B. 
Notwithstanding the aforesaid, the Valley Township Police Department is hereby authorized to issue a permit extending the thirty-day period for an additional 30 days. Such permit must be obtained every 30 days and can be obtained only upon submission of such proof as may be reasonably necessary to show cause for the issuance of such permit. Such cause may include, but is not limited to, proof of order of individual and/or separate parts necessary to put the vehicle(s) in good running order so as to qualify for State inspection as aforesaid.
C. 
Antique motor vehicles and classic motor vehicles, as defined in the Vehicle Code of the Commonwealth of Pennsylvania, are exempted under this Part, provided such vehicle(s) displays (display) the appropriate plate of the Department of Transportation showing it (them) to be so registered.
D. 
Vehicles which are exclusively used for racing purposes on licensed tracks in this state or other states are exempt from the provisions hereunder, provided adequate proof is submitted to the Valley Township Police Department evidencing that the vehicle(s) is used for racing on such licensed track(s) at least four times a year. Upon the submission of such proof, the Valley Township Police Department is authorized to issue a permit exempting such vehicle from this Part. Such permit must be renewed yearly.
E. 
Nothing in this section shall be construed to prohibit the maintenance of a property owner or his tenant from storing or maintaining one unregistered motor vehicle on his property either within a garage or under an opaque cover, so long as the said motor vehicle is capable of being moved under its own power.

It shall be unlawful for any person, persons, firm or corporation to dump, discharge, keep, store, maintain, cause or permit to accumulate on any highway, street, alley or public property any abandoned, wrecked or junked automobile or the stripped chassis or body of an automobile.

Any person, firm or corporation who shall violate any provision of this Part shall be guilty of a summary offense punishable by a fine not to exceed $1,000, together with all court costs and reasonable attorney's fees incurred by the Township in any such enforcement proceeding, and may further be punished by imprisonment to the extent permitted for summary offenses. Each day that a violation continues may be considered a separate offense.
