(a) 
The head of the Office of the City Clerk shall be the City Clerk. The Clerk shall serve for a term of three (3) years (R.S. 40A:9-133), beginning January 1 of the year in which s/he is appointed; provided that any appointment to fill a vacancy shall be for the unexpired term only, except as otherwise provided by law. Prior to his/her appointment, the Clerk shall be qualified by training or experience, or a combination thereof, for the duties of his/her office.
(b) 
Under the direction and supervision of the Mayor and City Council, the Clerk shall:
(1) 
Serve as Clerk of the Council, subject to the provisions of Section 2:2-7 of the Code;
(2) 
Have custody of the City's seal and affix it to such books, papers and documents as may be authorized pursuant to law;
(3) 
Have and take custody of all official books, papers and documents of the City for which no other repository is provided by the Charter or ordinance, and preserve and keep them safely;
(4) 
Perform such functions as are vested in the Clerk by the licensing provisions of State law or ordinance;
(5) 
Administer oaths or affirmations with respect to all City matters;
(6) 
Issue "certificate as to liability for assessment for municipal improvements" in accordance with provisions of Laws of 1946, Chapter 269 (N.J.S.A. 54:5-18.1 et seq.). Prior to the issuance of any such certificate, s/he shall secure from the City Engineer his/her counter-signature, which shall indicate that to the best of his/her knowledge, information and belief the certificate is correct; and,
(7) 
Appoint a Deputy Clerk who shall perform the functions, powers and duties of a Clerk in the absence of the Clerk.
(a) 
Within the Office of the City Clerk, there shall be a Bureau of Licenses, the head of which shall be the City Clerk; provided however, the Mayor may assign all or part of the functions of the Bureau of Licenses to any other Division of the City.
(b) 
Subject to the direction and supervision of the City Clerk, the License Bureau shall:
(1) 
Receive and process all applications for licenses or renewals thereof;
(2) 
Refer all applications to the proper investigating and issuing agency; and,
(3) 
Supervise and provide all services incident to the issuance of a license by the issuing agency.
(c) 
The issuing agency for a license shall be either the Mayor or the Council, as provided by Statute, the Plainfield Charter (1968) or by this Code.

The City flag depicts a golden crown in a white sunburst, encircled in blue and white; with a blue and gold stripe. An official copy of the City flag is on file with the City Clerk.

(a) 
The City Clerk has charge of the City flag.
(b) 
All use of the City flag is restricted to official City business and such other appropriate uses that further the operations of the City as may be authorized in writing by the City Clerk, or as otherwise specifically permitted in this Code.
(c) 
No person may make or use the City flag, or any cut, facsimile, or reproduction thereof, or make or use the flag, or any design which is an imitation, in the design of, or which may be mistaken for the City flag or the design of the City flag, without the written authorization of the Mayor or the Mayor's designee.
(d) 
City officers, City employees, members of the City Council, and members of City boards and commissions may use the City flag, or facsimile of the City flag, while acting within the scope of their office or employment.
(e) 
No person, including any elected officer of the City, may use the City flag, or facsimile of the City flag, in any correspondence or other printed materials distributed in favor of or against any ballot measure or in favor of or against any candidate for public office.
(f) 
The City flag may be at times requested to be used by outside entities or agencies for events co-hosted or supported by the City, for a limited time, using a form approved by the City Council. All such requests must be submitted to the Mayor or the Mayor's designee, who has the sole discretion to approve or deny such requests and to promulgate the manner, timing, and format of such requests. When considering such requests, the Mayor or the Mayor's designee will consider the ultimate benefit to the City of such use, the effects of association by the City with the event or occurrence, the City's traditional sponsorship activities, and other criteria which shall be fairly and neutrally applied to all requestors. The decision of the Mayor or the Mayor's designee regarding use of the City flag may be appealed to the City Council by submitting a written protest to the City Clerk's office within fourteen (14) days of the Mayor's or the Mayor's designee's decision.
(g) 
It shall be unlawful for any person to make or use the City flag of the City of Plainfield deceptively, fraudulently, or without express written permission from the City of Plainfield. Unauthorized use of the City flag is declared a public nuisance, and the City can abate or enjoin such use pursuant to this section.
(h) 
Pins, insignia and other articles. From time to time, the Mayor or an individual City Council member may wish to incorporate the City flag into a pin, insignia, or other article for use in ceremonial occasions or for other civic purposes but not for sale or commercial purposes. Each such proposed design must be submitted to the Mayor for approval, and the production of such items after approval shall be at the sole expense of the creator of the design.
