The Commission shall consist of seven (7) members and two (2) individuals to serve as an alternate during the absence or disqualification of a regular member, who are residents of the City or serve as Chair of Plainfield-based Hispanic organizations that represent various Hispanic communities throughout the City. The Commission members shall be appointed by the Mayor with the advice and consent of the City Council, consisting of one (1) Council member, one (1) representative of the Mayor, and seven (7) members of the public. The Council appointee shall serve during his/her term of office and the Mayoral appointee shall serve during the term of office of the Mayor or until cessation of employment with the City, whichever first occurs. Public members shall serve for a term of four (4) years from the date of their appointment and until their successors are appointed and qualified; except the initial appointments hereunder shall serve staggered terms as follows: one (1) shall be for a term of one (1) year, two (2) for (2) years and four (4) for three (3) years.

Vacancies resulting from causes other than expiration of term shall be filled for the unexpired term only and shall be filled in the same manner as the original appointments were made.

All members of the Commission shall serve without compensation. The Commission may submit a budget request of no more than five thousand dollars ($5,000.00) a year to the City Council annually for the reimbursement of expenses for the work of the Commission.

The Commission shall select from among its members a Chairperson and also shall select a Secretary who need not be a member of the Commission.

(a) 
It shall be the duty of the Commission to advise the Mayor and City Council on the needs, concerns, accomplishments and contributions of the Hispanic community as well as the impact of legislation or the lack thereof and its effect on the Hispanic community.
(b) 
The Commission shall elicit input from the Hispanic community by visiting community centers, meeting with community leaders, attending and sponsoring community meetings and taking any other actions it deems necessary to carry out its purposes. The Commission shall report to the Mayor and City Council on its findings and recommendations a minimum of once a year.
(c) 
In addition, the Commission shall:
(1) 
Identify key departments within city government which interact with the Hispanic community and work with Administration officials through the City Administrator to explore ways to improve and expand services through greater participation of qualified Hispanics in policymaking positions;
(2) 
Foster improved communications between the Mayor, Administration, the City Council and the Hispanic community by utilizing available resources more effectively;
(3) 
Identify and analyze important issues and recommend strategies for responding to them in ways that encourages and support the continued development of Plainfield's Hispanic community.
(4) 
Educate Hispanic residents about opportunities to serve the community, recruit and support Hispanic residents to become actively involved in the City's boards, commissions and political bodies.

The Commission shall be entitled to request assistance and avail itself of the services of the City's administration through the City's Administrator to carry out its purposes.

This Commission shall dissolve itself a year after a U.S. Census Department reports that Plainfield's Hispanic population has risen to forty-five (45%) percent of the total Plainfield population and a minimum of thirty-five percent (35%) of the Plainfield's registered voters are Hispanic.
