Discharge of water onto a public way is prohibited. No person shall alter existing conditions as to allow, or cause, the man-made diversion or backup of water onto a pubic roadway or sidewalk of the Town, by pump, downspout, swale, grading of land, or any other method, so as to create a hazard to vehicle or pedestrian travel on such roadway or sidewalk.
Whoever violates this bylaw shall, within 30 days of receiving a notice of violation, take any and all corrective actions necessary to prevent future violations of this bylaw, or submit to the Department of Public Works a plan of action to prevent future violations of this bylaw.
As an alternative to criminal prosecution, the Director of Public Works or any police officer of the Town may elect to enforce this bylaw by utilizing the noncriminal disposition procedure set forth in M.G.L., C. 40, § 21D, as may be amended from time to time. The fine for each noncriminal violation shall be § 300, and each day or portion of a day on which a violation exists shall constitute a separate offense.
