A Municipal Court for the Borough of Peapack and Gladstone is established, as of January 1, 1949, pursuant to the provisions of Chapter 264 of the Laws of 1948, as amended and supplemented.

The name of the Municipal Court shall be the "Municipal Court of the Borough of Peapack and Gladstone."

The Municipal Court shall have a seal which shall bear the impress of the name of the Court.

There shall be a Judge of the Municipal Court, who shall be appointed by the Mayor, with the advice and consent of the Council, and who shall serve for a term of three (3) years from the date of his appointment and until his successor is appointed and qualified.

The Judge of the Municipal Court shall receive an annual salary fixed by municipal ordinance, to be paid in the same manner as salaries of other municipal officers are paid, and which shall be in lieu of all fees, costs, and any other allowances whatsoever.

The Municipal Court and the Judge thereof shall have, possess and exercise all the functions, powers, duties and jurisdiction conferred by the provisions of Chapter 264 of the Laws of 1948, as amended and supplemented, or by any other law.

The Municipal Court shall be held in the Municipal Complex. The Judge shall sit at such times as the business of the Court may require, subject to the rules applicable to municipal courts.

a. 
Office Created. There is hereby created the office of Public Defender for the Borough of Peapack and Gladstone Municipal Court which office shall be filled by appointment of the Mayor with the advice and consent of the Borough Council for a yearly term commencing on January 1 and ending December 31. The appointee shall continue in office until his or her successor is appointed and qualified. Any appointment to fill a vacancy shall be for the unexpired term only.
b. 
Duties. The duty of the Public Defender shall be to represent any indigent defendants which the Municipal Court may determine as qualified for such services.
c. 
Application Fees for Public Defender.
1. 
Any person applying for representation by the Municipal Public Defender shall pay an application fee of up to two hundred ($200.00) dollars at the discretion of the Municipal Court Judge.
2. 
The Municipal Court may waive the application fee in whole or part if the Court determines, in its discretion, that the application fee represents an unreasonable burden upon the person seeking representation.
