Pursuant to the authority granted in N.J.S.A. 40A:9-136, 137, and 138 inclusive, there is hereby created the position of Borough Administrator to administer the business affairs of the Borough.

a. 
Appointment. The Administrator shall be appointed by the Mayor with the advice and consent of the Council. In the event of vacancy, the Mayor shall make such appointment within thirty (30) days after the office becomes vacant. If the Mayor fails to make this appointment within the allotted thirty (30) days, the Council may appoint an Administrator at the expiration of the thirty (30) day period.
b. 
Term. The Administrator will serve at the pleasure of the Council. The Administrator may be removed in accordance with paragraph g.
c. 
Compensation. The Administrator shall receive a salary in a range as may be adopted by the Borough Council in the annual Salary Ordinance. In addition, the Administrator may earn additional compensation as a result of achieving singular objectives adopted annually and measured by the Council, the amount to be fixed by the Council as a percentage range of base salary within the salary ordinance.
d. 
Qualifications. The Administrator shall be chosen on the basis of executive and administrative abilities and qualifications with special regard to the areas of accounting, finance, education, training and experience in governmental affairs.
e. 
Vacation. The Administrator shall be granted the same vacation and paid holidays as have been established in the Borough personnel policy.
f. 
Absence or Disability. During the temporary absence or disability of the Administrator, the Mayor and Council may, by resolution, appoint an officer or regular employee of the Borough to perform the duties of the Administrator.
g. 
Removal. The Administrator may be removed by a two-thirds (2/3) vote of the full Council. The resolution shall become effective two (2) months after its adoption by the Council.
The Council may provide that the resolution shall have immediate effect, provided that the Council pay forthwith to the Administrator any unpaid balance of his or her salary for the next two (2) months following the effective date of termination.

a. 
General. The Administrator shall, under the supervision and control of the Mayor and Council, to the extent not prohibited by law.
1. 
Serve as the administrative officer representing the Mayor and Council.
2. 
Attend all meetings of the Council and other committees and boards as required.
3. 
Represent the Borough in its relations with the Federal, State and county governments and other municipalities and assert the Borough's interest in contracts, franchises and other business transactions.
4. 
Keep the Mayor and Council informed of the financial condition of the Borough and make such reports thereon as required.
5. 
Direct the administrative and other operations of the Borough and make recommendations for plans and programs to meet the needs of the Borough.
6. 
Receive and reply to inquiries concerning Borough business and provide information and assistance in respect thereto.
7. 
The duties of the Administrator shall be such that they shall not infringe upon the duties, rights and powers of other Borough officers designated by Statute or by Borough ordinance.
8. 
Maintain and distribute minutes of meetings.
b. 
Administration. The Administrator, to the extent not prohibited by law shall:
1. 
Arrange the business administration of all departments and offices in consultation with department heads and respective Council chairperson. The Administrator shall be responsible for the coordination of interdepartmental operations, as well as boards and commissions of the Borough with special regard to police, fire, public works, sewer utility, treasury, tax collection, borough clerk and tax departments. The Administrator will have direct supervision of the activities and employees of the offices of the Borough Clerk, Tax Collection, Treasury and Purchasing Coordinator and Superintendent of Public Works and Police Chief.
2. 
Establish through adoption by Council and then maintain sound personnel practices and maintain appropriate records of all employees.
3. 
Maintain a continuing review of all department operations and work schedules and report thereon to the Council.
4. 
Recommend and coordinate with appropriate department heads the nature, location and extent of public improvements and implement the execution of such improvements when authorized by the Council.
5. 
Implement and enforce the policy of the Mayor and Council with respect to the compiling and release of public information, including inquiries from the press and dissemination of news releases concerning the Borough.
6. 
Administer the disbursement of all Borough funds and approve all vouchers and bills before submitting same to the Mayor and Council for final approval.
7. 
Administer the cash management of the Borough and the prudent investment of such funds as temporarily may be in excess of the amounts needed to meet Borough obligations.
8. 
With the exception of employees or officers for whom specific statutory procedures apply, the Administrator shall have the authority to recommend the dismissal of any and all Borough employees. He or she shall have the authority to suspend immediately any and all Borough employees involved in the day-to-day operation of the Borough who are under his or her direct supervision. In case of suspension, it shall be his or her responsibility to orally notify two-thirds (2/3) of the governing body within twenty-four (24) hours, with written notice to the Mayor and entire Council to follow.
9. 
Continually review and supervise the Borough's insurance program and make appropriate changes when necessary.
10. 
Be responsible for the overall supervision and maintenance of real and chattel property owned by the Borough via a property accounting system.
11. 
Require the various departments to furnish an adequate inventory of all equipment, materials and supplies in stock, to recommend sale of any surplus, obsolete or unused equipment when authorized by the Mayor and Council.
12. 
As required from time to time by the Mayor and Council, assist in negotiations in collective bargaining and assist the governing body with employee relations.
13. 
Perform such other duties as may be assigned by the Council.
14. 
In concert with the appropriate Council committee and department head, assist in the screening and hiring process of Borough employees.
15. 
Administer the enforcement of all laws, ordinances and resolutions of the Borough.
c. 
Budgeting. The Administrator shall:
1. 
Receive from each department, office or board their annual request for appropriations, analyzing such reports, with recommendations in respect thereto, with the Administrator's comments to the Mayor and Council no later than January of each year.
2. 
Consult with the Mayor and Council with respect to the tentative budget, recording changes, additions and deletions thereto and submit final recommendations in the form required by law, together with an analysis of the various items of expenditure and revenue and such explanatory comments as may be required.
3. 
Each month provide the Mayor and Council with a year-to-date summary of expenditures versus appropriations with commentary on variances.

The Administrator shall furnish a surety bond which shall be approved by the Mayor and Council, this bond to be conditioned upon the faithful performance of his or her duties. The premium of this bond shall be paid by the Borough.

There shall be a Borough Clerk appointed by the Mayor and Borough Council. The term of office of the Clerk shall be three (3) years which shall run from January 1 in the year in which the Clerk was appointed.

No person shall be appointed as Borough Clerk unless he shall have a registered Municipal Clerk Certificate issued pursuant to N.J.S.A. 40A:9-113 et seq.

The clerk's salary shall be established in the Salary Ordinance.

Should the office of Borough Clerk become vacant, the Borough Council may appoint a person to serve as Acting Clerk for a period of not more than six (6) months.

The Borough Clerk shall:
a. 
Act as secretary of the municipal corporation and custodian of the municipal seal and of all minutes, books, deeds, bonds, contracts, and archival records of the municipal corporation. The Borough Council may, however, provide by ordinance that any other specific officer shall have custody of any specific other class of record;
b. 
Act as secretary to the Borough Council, prepare meeting agendas at the discretion of the Council, be present at all meetings of the Council, keep a journal of the proceedings of every meeting, retain the original copies of all ordinances and resolutions, and record the minutes of every meeting;
c. 
Serve as the chief administrative officer in all elections held in the Borough, subject to the requirements of Title 19 of the New Jersey Statutes Annotated;
d. 
Serve as chief registrar of voters in the Borough, subject to the requirements of Title 19 of the New Jersey Statutes Annotated;
e. 
Serve as the administrative officer responsible for the acceptance of applications for licenses and permits and the issuance of licenses and permits, except where Statute or ordinance has delegated that responsibility to some other Borough officer;
f. 
Serve as coordinator and records manager responsible for implementing local archives and records retention programs as mandated pursuant to Title 47 of the New Jersey Statutes Annotated;
g. 
Perform such other duties as are now or hereafter imposed by Statute, regulation or by ordinance or regulation.

There shall be established the position of Chief Financial Officer of the Borough. The Chief Financial Officer shall be a Certified Municipal Officer as such terms are defined in N.J.S.A. 40A:9-140.1 et seq. The Chief Financial Officer shall be appointed by the Borough Council and shall serve at the pleasure of the Governing Body. The Chief Financial Officer may, but need not, be a person who is also employed by the Borough in another capacity.

The Chief Financial Officer shall carry out the responsibilities set forth under N.J.S.A. 52:27BB-26 et seq.

Compensation for the Chief Financial Officer shall be established by ordinance. When the Borough Treasurer is directed to serve simultaneously as Chief Financial Officer, such person shall receive no compensation for service as Chief Financial Officer other than the salary established by ordinance for the Borough Treasurer.

Pursuant to the provisions of N.J.S.A. 40A:11-9, there is hereby established in the Borough the position of Purchasing Agent, which shall be known as the "Purchasing Coordinator" of the Borough.

The Purchasing Coordinator shall be appointed by the Mayor with the advice and consent of the Borough Council.

The Purchasing Coordinator shall have the following power and authority, in addition to all those provided by law:

The Coordinator shall prepare public advertising for bids when required by Statute:
b. 
Subject to the provisions of the Local Public Contracts Law the Coordinator shall attend to the publication of advertisements for bids, shall receive such bids including all documents required thereby, and shall prepare a comparative listing of all bids received for the appropriate committee of the Borough Council. Thereafter, the bids shall be reviewed by the committee with the Borough Council and an appropriate award may be made.
c. 
The Purchasing Coordinator shall undertake to notify the successful bidder of the award.
d. 
The Purchasing Coordinator shall have the following additional powers and duties:
1. 
Where the estimated cost of the item or service to be purchased shall not exceed two hundred ($200.00) dollars, the Purchasing Coordinator shall have the power and authority to make the award of contract to the lowest responsible bidder subject to Borough Council approval. Such bidder may be established on the basis of bids received by telephone.
2. 
Where the estimated cost of the item or service to be purchased shall exceed the amount as provided by Statute, the Purchasing Coordinator shall obtain informal bids or quotations when practicable from at least three (3) bidders. Thereafter, the Purchasing Coordinator shall present the quotations to the Chairman of the Finance Committee or the Standing Committee having jurisdiction for approval of the quotation from the lowest responsible bidder. Upon receiving such approval, the Purchasing Coordinator may award the contract subject to the approval of the Borough Council.
3. 
Where the estimated cost of the item or service to be purchased is two thousand five hundred ($2,500.00) dollars or more, the provisions of the Local Public Contracts Law shall be complied with.

The position of Deputy Zoning Officer of the Borough of Peapack and Gladstone is hereby established. Appointments to the office of Deputy Zoning Officer shall be made by the Mayor, subject to the confirmation of the Borough Council of the Borough of Peapack and Gladstone. The term of office shall be for one (1) year. If the appointment is made any time after the reorganizational meeting of the Borough the term shall expire on December 31 of that year.

a. 
The Deputy Zoning Officer shall, at the request of the Zoning Officer, or otherwise in the discretion of the Borough Administrator, fill the Office of the Zoning Officer with all the powers thereof.
b. 
When filling in for the Zoning Officer, the Deputy Zoning Officer shall have concurrent jurisdiction with the Zoning Officer with respect to issuance of notices to individuals to cease and desist from violating the Zoning Ordinance, to sign and file complaints alleging the violation of any Zoning Ordinance in a Municipal Court in the Borough of Peapack and Gladstone, and may take any other action which the Zoning Officer is authorized to take pursuant to this section or at law.

The salary of the Deputy Zoning Officer shall be set by the Mayor and Borough Council of the Borough of Peapack and Gladstone.
