As used in this Chapter:
POOL
Shall mean any private swimming pool or tank on residential property, whether permanently installed, portable, collapsible or otherwise, having a depth of twelve (12") inches or more, or a capacity of one hundred (100) cubic feet or more.
[1967 Code § 22-1-4; Ord. No. 2372-11 § 2]
a.
All swimming pools shall be maintained and operated in such manner as to be clean and sanitary at all times. The bottom and sides of the pool shall be light in color. No type of paint considered injurious to health shall be used, nor shall sand or dirt bottoms be permitted.
b.
Markings shall be provided showing the location and depth of the shallow and deep portions. This provision requiring markings shall apply to all existing pools, as well as pools constructed subsequent to December 21, 1964.
c.
No private swimming pool shall be wholly or partially emptied into the sanitary sewer system of the Township if a storm water drain is readily accessible to the premises upon which the pool shall be located, for the reception of water from such pool. Where, however, only the sanitary sewer system is available for the reception of water dischargeable from such pool, such discharge into such system shall be permitted only at a time of which previous notice shall have been given to and for which permission shall have been received from an authorized representative of the Department of Public Works of the Township.
d.
The discharge location shall not create a public nuisance which is any thing, condition, or act which is or may become injurious or hazardous to the public or adjacent property.
[1967 Code §§ 22-1-5, 22-1-6]
a.
There shall be no physical connection between a potable public or private water supply system and any private swimming pool, wading pool or portable pool below the maximum water line of the pool or to a recirculating or heating system of such pool. The piping system shall be designed to fill the pool and circulate the pool water through filtering equipment. Potable water shall feed the pool with a downspout with an air gap not less than six (6") inches above the pool overflow level. Potable water siphons shall not be permitted to drain pools. The installation, repair and control of plumbing facilities shall comply with the Township Plumbing and Sanitary Codes.
b.
All circulating units shall have sufficient capacity to recirculate the entire contents of a pool within eighteen (18) hours or less.
c.
All pools not equipped with facilities for the recirculation and reuse of the pool water shall be subject to closure by order of the Board of Health during any period of emergency water shortage.
d.
All areas surrounding any swimming pool shall be maintained neatly, and no rubbish, debris or litter shall be permitted to remain or accumulate in or about any pool.
[1967 Code § 22-1-7]
No artificial lighting shall be maintained or operated in connection with any swimming pool in such a manner as to be a nuisance or annoyance to neighboring properties. Such lighting shall not shine directly upon any abutting property. All lighting shall be properly shielded.
[1967 Code § 22-1-9]
a.
All private swimming pools existing on or constructed, installed, established or maintained after December 21, 1964, shall be enclosed by a permanent fence of durable material at least four (4') feet in height, and shall be constructed so as not to have openings, mesh, holes or gaps larger than four (4) square inches in any dimension, except for doors and gates. If a picket fence is erected or maintained, the horizontal dimension shall not exceed three (3") inches. All gates used in conjunction with the fence shall meet the same specifications as the fence itself, shall be equipped with approved latching devices and shall be latched at all times when the private swimming pool is not attended.
b.
All portable pools, unless enclosed by a fence of the type and dimensions specified in paragraph a of this subsection, shall be either (1) emptied when not in use or unattended; or (2) covered with a suitable, strong protective covering, securely fastened or locked in place, when not in use or unattended.
[1967 Code § 22-1-10]
All swimming pools shall be constructed, installed and maintained so as to provide equipment necessary for the chlorination or other disinfection, filtration and recirculation of the pool water so as to comply with such bacteriological standards as may be promulgated by regulations issued by the Board of Health of the Township and the State.
[1967 Code § 22-1-11]
Every private swimming pool constructed, installed, established or maintained in the Township shall at all times comply with the requirements of the Township Board of Health. Any nuisance or hazard to health which may develop in or in consequence of or in connection with any such private swimming pool, wading pool or portable pool shall be forthwith abated and removed by the owner, lessee or occupant of the premises on which the pool is located, upon receipt of notice from the Township Health Officer.
[1967 Code § 22-1-12]
The provisions of this Chapter, whenever applicable, shall apply to portable or collapsible pools, wading pools and fish ponds.
[1967 Code § 22-1-14]
It shall be the duty of the Building Subcode Official and the Health Officer to enforce the provisions of this Chapter.
[1967 Code § 22-1-15]
The owner or operator of any pool within the Township shall allow the Building Subcode Official and the Health Officer or other authorized official access to any private swimming pool or wading pool or portable pool and appurtenances thereto for the purposes of inspection to ascertain compliance with this Chapter and all other pertinent Township ordinances, at all reasonable times.
