A. 
CODE - Means the 1995 Municipal Code of the City of Davenport, Iowa, and as may be amended from time to time.
B. 
REPEAT OFFENSE - Means a recurring violation of the same section of the code by the same individual or entity.

A. 
Any violation of the code is a municipal infraction except for violations of prohibited by state law from being municipal infractions.
B. 
Each day a municipal infraction occurs constitutes a separate offense.
C. 
Unless another civil penalty is provided elsewhere in this code for a specific violation, a municipal infraction is a civil offense punishable by a fine not to exceed the maximum penalty permitted by the State Code of Iowa.
D. 
Unless otherwise provided, a repeat offense of any municipal infraction is punishable by a civil fine not to exceed the maximum penalty permitted by the State of Iowa Code.
E. 
Seeking a civil penalty as authorized in this chapter does not preclude the City from seeking alternative relief from the court in the same action. Such alternative relief may include, but is not limited to, an order for abatement or injunctive relief.
F. 
Nothing contained herein shall preclude a peace officer from issuing a criminal citation for a violation of the code as provided for in Chapter 1.20.

A. 
Any employee or other official designated by the City Administrator to enforce the code may issue a civil citation to a person who is alleged to have committed a municipal infraction.
B. 
The citation shall serve as notification of the violation of the code, and shall be served by personal service or by certified mail, return receipt requested. One copy of the citation shall be filed with the clerk of the district court, one shall be retained by the City, the defendant shall receive one copy and one copy shall be provided to the City Attorney.
C. 
The citation shall serve as notification of an allegation that a municipal infraction has been committed and shall contain the following information:
1. 
The name and address of the alleged violator.
2. 
The name or description of the alleged infraction, attested to by the officer issuing the citation.
3. 
The location and time of the alleged infraction.
4. 
The amount of civil penalty for the violation charged and the court costs, or the alternative relief sought, or both.
5. 
The manner, location, and time in which the penalty may be paid.
6. 
The time and place of court appearance.
7. 
A statement of the penalty for failure to appear in court.
