The Municipal Golf Course located in Veterans Park shall be known as "Cedar Creek at Berkeley Municipal Golf Course."

No person shall be entitled to use the facilities of the Cedar Creek at Berkeley Municipal Golf Course or be on or about the course without having first registered before each play and having been issued a permit to do so. Such permit shall be evidenced by a receipt showing that the person using the course has paid the appropriate fees for such use as delineated herein. Permits, when issued, shall entitle the holder to use the facilities of the course and to be on or about the course only on the day when issued. All greens fees are for 18 holes of play only.

Twilight hours, holidays and additional discounted play schedules shall be established by the Clubhouse Supervisor, at his discretion, to attempt to maximize the utilization of the golf course. The times and schedule of twilight rates, holidays and discounted play schedules shall be posted in a conspicuous location. There shall be no time restrictions on any rates except for twilight.
e. 
Winter Rates. Cart and greens fees during the months of December, January and February are as follows:

The above rates are per person, regardless if there are one or two persons riding in the cart.
f. 
Residents of the Township of Berkeley may obtain an annual permit upon the payment of greens fees of $900 for an individual. The holders of any such permit shall be entitled to play an unlimited number of rounds seven days per week. Nonresidents may be issued an annual permit upon the payment of a fee of $1,550. The annual permit shall be effective for 12 months from the date of issuance. There shall be no apportionment of any said fees for that portion of the calendar year preceding the issuance of said permit.

g. 
Organized Leagues and Clubs. Organized leagues and clubs, if approved by the Clubhouse Supervisor, shall be entitled to use the course and must provide a list of all members of the club or league, in writing, to the Clubhouse Supervisor, prior to his approval. It will be the responsibility of the officers of the club or league to keep this list current.
h. 
School and college teams having qualified players from institutions located in Berkeley Township may use the golf course for practice and for matches, free of charge, provided that the coach or athletic director responsible for such team shall maintain with the Clubhouse Supervisor a current roster of eligible and authorized players. The coach or athletic director must be present at each round of play, and he will check in with the Clubhouse Supervisor in accordance with the list. Except for unusual circumstances, play will be confined to weekdays after 1:00 p.m.
i. 
Golf Carts. The fee, per person, including tax, for the use of a gas golf cart shall be as follows:

Members of a volunteer fire company or volunteer first aid squad recognized by the Township of Berkeley and veterans or active military personnel shall be entitled to 10% discount on all fees (greens, cart, rentals and purchases). Individuals shall present identification proving membership in such organization in order to obtain the discount.
o. 
Tournaments. Organizations having a minimum of 30 golfers, if approved by the Clubhouse Supervisor, shall be entitled to use the course upon the payment of the following greens fees which are applicable only to an early shotgun start on Tuesdays, Wednesdays and Thursdays. Vouchers for greens fees and cart fees will be issued for tournament rainouts. Vouchers must be used by the end of the current season.

p. 
High School golf teams having qualified players may use the golf course driving range for practice for a fee of $1,000 during the team season, provided that the coach or athletic director responsible for such team shall maintain with the Clubhouse Supervisor a current roster of eligible and authorized players. The coach or athletic director must be present at each round of play, and he will check in with the Clubhouse Supervisor in accordance with the list.

The registration shall be valid for a calendar year ending December 31. Registration shall be renewed annually. There shall be no apportionment of the fee for the portion of the calendar year preceding the issuance of the registration. Issuance of a registration to a Berkeley Township resident will be issued only upon the proof that the applicant is a resident of Berkeley Township. This proof may be submitted in the following forms:

A current New Jersey driver's license indicating a Berkeley Township address or a current tax bill bearing the individual's name; or

A current Township utility bill, automobile registration, credit card statement or sewer bill.

Any misuse of the registration or annual permit, including but not limited to loaning, selling or renting it to another, shall subject the owner thereof to revocation of the registration permit without privilege to renew, and any unauthorized user thereof shall be subject to revocation of golfing privileges at the course, or such penalties as may be prescribed by the Clubhouse Supervisor. Penalties for any violation of this section are in addition to any others prescribed herein or as otherwise provided by law. Any person subject to penalty hereunder shall be entitled, upon written request, to a hearing before the Clubhouse Supervisor.

A permit to do any act shall authorize the same only insofar as it may be performed in strict accordance with the terms and conditions thereof or as prescribed by the Clubhouse Supervisor. Any violation by its holder or his agents or employees of any such terms or conditions shall constitute grounds for revocation by the Clubhouse Supervisor, whose action therein shall be final. In the event of the revocation of any permit or registration hereunder, all moneys paid for or on account thereof shall be forfeited to and shall be retained by the Township, and the holder of such permit or registration, together with his agents and employees, who violated such terms and conditions shall be jointly and severally liable to the Township for all damages and losses suffered by it in excess of the moneys so forfeited and retained; but neither such forfeiture and retention by the Township of the whole or any part of such moneys nor the recovery or collection thereof of such damages, or both, shall in any manner relieve such person or persons from liability to punishment for any violation of any provision of this section or any other Township ordinance or rule or regulation.

The provisions of this chapter and all rules and regulations enacted and promulgated by the Course Authorities, designated by resolution by the Township Council, as herein provided, shall become the terms and conditions of each permit issued hereunder.

The Course Authorities designated by the Township Council by resolution or otherwise are hereby authorized to establish hours of operation for the Municipal Golf Course and to vary such hours when circumstances warrant.

Lessons on the Municipal Golf Course shall only be given by an approved golf professional, and amount of the fees for the lessons shall be established by the designated Course Authorities and shall be posted by the Clubhouse Supervisor. Fees shall be payable to the Township prior to the lesson.

The Golf Course Advisory Committee shall consist of seven members, who shall be appointed and serve at the pleasure of the Mayor. The Golf Course Advisory Committee shall meet at least once every month and assist by submitting reports and recommendations to the Township Council and to the officials designated by the Township Council to administer the Municipal Golf Course. The Golf Course Advisory Committee shall keep minutes and elect a Chairman and Secretary. The Golf Course Advisory Committee shall have no administrative powers or responsibilities.

The chief administrative responsibility for the administration of Veterans Park, exclusive of the golf course, shall be in the Superintendent of Parks, Beaches and Recreation, and his duties are more particularly described in Chapter 2 of this Code. The Golf Superintendent shall be responsible for the maintenance and operation of the golf course and the facilities attendant thereto, including the clubhouse, and shall report to and be directly responsible to the Township Administrator.

No person shall post, paint or distribute any circular or advertisement, display any matter for advertising purposes or engage in any activity for the purpose of attracting attention to any exhibition, show, performance or other display without the written permission of the Clubhouse Supervisor.

No person, group or organization shall solicit alms or contributions for any purpose without the written permission of the Clubhouse Supervisor.

No person without a written permit or the consent of the Clubhouse Supervisor shall cause or permit any animal owned by him, in his custody or under his control to go or be in any course area, and each such animal so found at large may be seized and disposed of as provided by law or ordinance governing the disposal of stray animals on highways or public property then in effect at the place where such stray animal may be seen.

No person shall utter loud and offensive or profane or indecent language; do any obscene or indecent act; throw stones or other missiles; annoy, obstruct, molest or interfere with any person, path, walk or public place; loiter or create a disturbance while under the influence of intoxicating liquor; do any act tending or amounting to a breach of the peace, as defined in the Township ordinances or State Statutes; enter or leave except at established entranceways or exits; introduce, carry or fire any firecrackers, torpedoes or fireworks; engage in, instigate, aid or encourage a contention or fight; assault any person; play games of chance, participate in the conduct of a lottery or use or operate any gaming machine, gaming table or instrument; drink, take, use or have habit-forming drugs; spit upon any walk, crossing, safety zone or the floors of any structure, bridge, platform or stairway; cast, throw or deposit on any walk, crossing, path, floor or surface any portion of any fruit, vegetable, foodstuff, paper, pasteboard litter or other substance; cast, throw or deposit on the ice or in the rivers, streams, brooks, ponds, waters and lakes any sticks, stones or pollute the rivers, streams, brooks, ponds, waters and lakes; enter upon any portion of the course in disregard of signs or posted notices forbidding the same; or fail to obey or interfere with any course officer or official in the proper performance of his duties.

No person shall kindle, build, maintain or use a fire. No person shall throw away or discard any lighted match, cigar, cigarette, tobacco, paper or other material within or against any building, structure, car, vehicle or enclosure or under any tree or in underbrush, unless it is to deposit same in a suitable container provided for the reception thereof.

No person or vehicle shall, between 1/2 hour after sunset and 1/2 hour before sunrise, loiter or remain in the course, except in an emergency and after notifying a Police Officer or the Clubhouse Supervisor or representative; and except when, where and for whom permission has been granted by the Clubhouse Supervisor for a group gathering, activity or function.

No person shall sell or offer for sale any object or merchandise or any other thing, except pursuant to a written permit issued by the Clubhouse Supervisor.

No person shall use or operate a boat, canoe, inflated float or raft in any course waters.

No person shall coast with handsled, bob, skis, cart or other vehicle on wheels or runners, except at such time and in such places as may be designated therefor by the Golf Course Superintendent.

No person shall engage in any other sports or games upon the course, including kite flying, model boating, model automobile and model aviation.

No person shall use, ride or drive a horse within the course area.

No person shall skate, sled, walk or go upon any ice, except at such time and upon such places as may be designated by the Golf Course Superintendent and until such ice is declared by or under the authority of the Golf Course Superintendent to be in a safe condition therefor.

No person or vehicle shall be on or about the golf course unless the person is a duly authorized player or an officer or employee of the Township or unless permission has been granted by the Golf Course Superintendent for another specific use of the course.

No person shall drive or operate any vehicle other than authorized golf carts upon the grounds of the golf course. The term "authorized golf carts" means those that are provided by and at the golf course solely for use thereon. Vehicles shall be permitted only upon the driveways, roads and parking lots of the course.

No person shall use the course, course drives, parking places or parkways for the purpose of demonstrating any vehicles, nor for the purpose of instructing another to drive or operate any vehicle, nor for learning to drive or operate any vehicle; nor shall any person use any course area, including parking places, for the repairing or cleaning of any vehicle, except in an emergency.

No owner or driver shall cause or permit his vehicle to stand anywhere outside of designated parking spaces, except for a reasonable time in a drive to take up or set down passengers.

When a road, drive or parkway shall be restricted as to traffic or closed and duly marked by signs, road markings or barricades, it shall be a violation of this chapter to fail to observe and obey such signs, road markings or barricades.

Whenever any police or other representative shall indicate or direct, by gesture or otherwise, that the speed of a vehicle shall be checked or stopped or its course altered, the driver thereof shall immediately obey such directions.

No person shall operate and no owner shall cause or permit any vehicle to be operated recklessly or negligently or at a speed or in such a manner as to endanger or injure other persons or property.

All State Statutes regulating motor vehicles and their use shall be applicable to all the areas of Veterans Park.

No person without a permit shall injure, deface, displace, remove, fill in, raise, destroy or tamper with any part of the course, take up or remove or carry away any sod, stone, gravel, clay or earth; or make any excavation of any kind, name or nature; or harvest, cut, injure or remove any ice; or injure, deface, displace, remove or destroy any structure, building or any other property or equipment, real or personal, owned by or under the jurisdiction or control of the Township, or appertaining to the creation, government, use or maintenance of the golf course; or injure, or in any way interfere with the operation of any machine or instrument used in the course; or injure, deface, displace, remove or destroy any sign, inscription, post or monument erected or marked for any purpose.

No person shall destroy, cut, break, deface, mutilate, injure, sever from the grounds or remove any plant, flower, shrub, tree or other growing thing.

No person shall throw, cast or discharge into any of the waters of the course any substance, matter or thing, liquid or solid, which may result in the pollution of the waters.

Any person who violates any provision of this chapter shall, upon conviction, be liable to the penalty stated in Chapter 1, § 1-5.
