This chapter shall be known and cited as the "City of Havre de Grace's Subdivision Regulations." The subdivision regulations shall include the text, graphics and regulations, and any amendments thereto.
The purpose of the subdivision regulations is to establish procedures and standards for the development and subdivision of land within the City of Havre de Grace, hereinafter referred to as the "City." It is further designed to provide for the orderly growth, development and redevelopment of the City for the coordination of streets and highways within proposed subdivisions with existing or planned streets and highways and with other public facilities, for the dedication or reservation of recreation and other public use areas serving residents of the immediate neighborhood within the subdivision and rights-of-way or easements for street and utility purposes; and for the distribution of population and traffic in a manner that will avoid congestion and overcrowding and will create conditions compatible with protection of the public health, safety and the general welfare, water quality and areas of significant/special natural features. These regulations are designed to facilitate adequate provisions for potable water delivery and firefighting capabilities, wastewater collection and conveyance, roadways, pedestrian circulation, public recreation facilities (where applicable) and stormwater management facilities. It shall also provide for the developer's proportionate share, upon demonstrated need, for improvements to the supply and conveyance of potable water, for the pumping and treatment of wastewater, and for improvements to off-site roadways and intersections to provide adequate levels of service as established by the City of Havre de Grace.
A. 
These regulations govern all areas within the municipal limits of Havre de Grace. It shall be unlawful to subdivide any parcel unless the subdivision is in compliance with the terms of this chapter or is expressly exempted herefrom.
B. 
The Planning Commission shall have control over subdivisions as provided in the subdivision control provisions of the Land Use Article of the Annotated Code of Maryland. The jurisdiction of the Commission over plats shall be exclusive within the territory under its jurisdiction. All subdivisions shall be approved by the Commission.
Unless otherwise stated herein, definitions shall be per § 205-13 (Definitions) of the City Code, as amended.
SUBDIVISION
The division of a lot, tract or parcel of land into two or more lots, parcels, sites or other divisions of land for the purpose, whether immediate or future, of sale or of building development.
