The airport commission is hereby established.

(a) 
The airport commission shall consist of seven members. Six of the members shall be chosen from the citizens of the City without regard to political party affiliation and with reference to their fitness to formulate the policies and perform the duties prescribed for the airport commission by this article. During the month of April of each year two such members shall be appointed by the Mayor, with the consent and approval of the City Council, and each member so appointed shall serve a term of three years and until his successor is appointed and qualifies. The seventh member shall be a member of the City Council appointed by the Mayor, with the same powers and duties as the other members of the commission, except that such Councilmember shall not be an officer of the commission. Such Councilmember shall be appointed by the Mayor annually during the month of April each year and shall serve until his successor is appointed and qualifies. The Mayor shall be an ex officio member without vote, except that in case of a tie vote he shall cast the deciding vote. Any vacancy in the appointed membership of the airport commission shall be filled when it occurs for the unexpired term in the same manner as an original appointment.
(b) 
The member of the City Council appointed to the airport commission shall be a liaison between the airport commission and the City Council and shall report to the Council concerning the activities of the airport commission. He shall also take back to the airport commission such recommendations and suggestions as may be offered or proposed by the Council.

(a) 
Appointed members of the airport commission shall serve without compensation, and the Mayor shall be entitled to no additional compensation as an ex officio member of such commission.
(b) 
The airport commission shall operate on a nonpartisan basis on behalf of the citizens of the City.

The members of the airport commission shall meet in the City Council chamber each year within 10 days following the appointment of new members and shall organize by electing one of their members as president, and one as secretary, and by the election of such other officers as they may deem necessary. They shall make and adopt such bylaws, rules and regulations for the management, maintenance and operation of the Butler Municipal Airport as they shall deem expedient.

The construction, maintenance, operation and management of the Butler Municipal Airport are hereby declared to be functions of the City government, and all officers and members of the airport commission are hereby relieved of any and all legal liability which may arise from construction, operation and maintenance of the Butler Municipal Airport, and the airport commission shall be protected from claims by adequate insurance and legal counsel provided by the City. Any insurance needs shall be procured by action of the City Council. The foregoing shall not relieve airport commission members of fiscal honesty and responsibilities.

(a) 
The airport commission shall control the expenditure of money collected to the credit of the Butler Municipal Airport fund, and the equipping of the airport and the grounds and other property, real and personal, belonging to the airport. All money from taxes, operating revenues, donations and other sources shall be deposited in the treasury of the City to the credit of the Butler Municipal Airport fund, and drawn upon by the vouchers of the proper officers of the airport commission.
(b) 
The airport commission shall employ such help, professional and otherwise, as may be necessary to carry out the spirit and intent of the provisions of this article. All such assistants and employees shall serve at the pleasure of the airport commission.
(c) 
Any taxes that may be levied according to the provisions of state statutes in such cases made and provided shall be levied and collected in the same manner as the regular municipal taxes.

The airport commission is hereby empowered to act in the name of the City to enter into and obtain such options, contracts, deeds and other legal instruments as may be necessary for the management, maintenance and operation of the Butler Municipal Airport, subject to the needs and fiscal resources of the airport commission. The airport commission may utilize other City-owned equipment and City personnel utilities as may be available, the costs of such being charged against the Butler Municipal Airport as a book charge.

The Butler Municipal Airport shall be self-sustaining insofar as finances are concerned, and the airport commission shall so operate the municipal airport so as to provide for the upkeep, maintenance and operation thereof from the revenue received from the operations of the airport.
