Wherever a space is marked off for the parking of an individual
vehicle, every vehicle parked there shall be parked wholly within
the lines bounding that space, and it shall be a violation of this
chapter for any person to park a vehicle or allow it to remain parked
otherwise.
If any person parks a vehicle on public or private property
reserved for a handicapped person or severely disabled veteran where
the vehicle does not display the appropriate sticker authorizing such
use or where the vehicle displays such sticker but the operator is
not handicapped or a severely disabled veteran and no handicapped
person or severely disabled veteran is being transported by the vehicle,
then the operator of said vehicle shall be subject to a fine as set
forth in the Borough Fee Schedule.
No person shall stop, stand or park a vehicle at any time upon
any of the streets or parts thereof where appropriate signs are posted.
The penalty for such violation is as set forth in the Borough Fee
Schedule.
It shall be unlawful for any person to park any vehicle or to
allow the same to remain parked in any special purpose parking zone
where appropriate signs are posted or appropriately marked. The penalty
for such violation is as set forth in the Borough Fee Schedule.
No person shall park a vehicle upon any of the streets or parts of streets where appropriate signs are posted and as listed in Schedule I in §
195-37. The penalty for such violation is as set forth in the Borough fee schedule.
Any Wayne County resident who secures from the County Area Agency
on Aging a sticker to be displayed on the rear bumper authorizing
free meter parking on Thursdays and Fridays from 9:00 a.m. to 12:00
noon shall be authorized to park free of the obligation to deposit
coins in the meters during those hours or such other hours as approved
by the Borough Council.
Any person who violates any provision of this chapter shall,
upon conviction, be sentenced to pay a fine as listed in the Vehicles
and Traffic Fee Schedule for Honesdale Borough. However, it shall
be the duty of the police officers or parking enforcement officers
of the Borough to report to the Borough of Honesdale all violations
of any provision of this article, indicating, in each case, the section
violated, the license number of the vehicle involved in the violation,
the location where the violation took place and any other facts that
might be necessary in order to secure a clear understanding of the
circumstances attending the violation. The police officer or parking
enforcement officer making the report shall also attach to or place
upon every such vehicle a notice stating that the vehicle was parked
in violation of this article. The notice shall contain instructions
to the owner or driver of vehicle to make payment at any fine-o-meter
boxes or City Hall for the sum of violation within 24 hours. After
24 hours all fines increase. If such fine is not paid within a seven-day
period, the matter shall be referred to the District Justice for nonpayment.
All fines and penalties are as provided in the Vehicles and Traffic
Fee Schedule.
