A. 
Combined sewer permit. Any combined sewer connection to the public sewer system requires a combined sewer permit from the Director of Public Works. The Director of Public Works may deny a combined sewer permit whenever it is reasonably possible to prevent surface runoff from entering the public sewer system.
B. 
Cesspools. Any and all violations of state law regarding cesspools and/or their removal, replacement, or abandonment, including but not limited to the provisions of RIGL Title 23, Health and Safety, and the Rhode Island Cesspool Act of 2007, as may be amended from time to time shall be enforced by the Director of Public Works or Town Manager as a violation of this chapter.
(1) 
The Director of Public Works may require connection to a public sewer system at the time of removal, replacement or abandonment of any cesspool whenever such connection is reasonable.
C. 
Cross-connection is not permissible in the Town of Westerly.
D. 
Septic. Whenever a new septic system or tank is to be installed, or whenever a septic system or tank is to be replaced, it shall require a building permit.
(1) 
The Director of Public Works shall have the authority to deny such a building permit and require connection to the public sewer system whenever such connection is reasonable.
E. 
Sewer improvement loan program.
(1) 
Creation. The Town Manager and Director of Finance shall seek to create a Sewer Improvement Loan Program with the goal to create affordable financing for any party eligible for the program. The Town Manager and Director of Finance shall set forth regulations guiding the program.
(2) 
Loans. Any loans granted through this program shall be recorded as a lien against the real property subject to the improvement and may further require a performance bond in the discretion of the Town Manager whenever the Town Manager deems the work to be performed to be at such a scale that failure to timely complete such sewer improvement work may create a public nuisance.
(a) 
Eligibility. Any party required to improve sewer, stormwater, cesspool, run off, sump pump sewer connections or other related improvements as a result of this article shall be eligible for the Sewer Improvement Loan Program.
