As used in this article, the following terms shall have the meanings indicated:
DESIGNATED AREA
A place designated by the Fire Official where smoking may take place.
FIRE OFFICIAL
The Township Fire Marshal or his designee.
PROHIBITED AREA
Any place within the Falls Township Municipal Complex or on property owned by Falls Township that is not a designated smoking area.
SMOKING
The action or habit of inhaling and exhaling the smoke of tobacco by sucking on the end of a lit cigarette, cigar, pipe, etc. For purposes of this article, this shall include possession of a lighted cigarette, cigar, pipe or other lighted smoking instrument as well as vaping.
TOBACCO USE
Includes smoking and the use of smokeless tobacco or tobacco products in any form.
Smoking and tobacco use in any form is prohibited except in designated areas, and such use shall be unlawful and a violation of this article.
A. 
The Fire Official is empowered to post no-smoking signs in and around all Township-owned property in which smoking and tobacco use is prohibited hereby. The Fire Official is also empowered to post signs indicating where areas have been identified as designated areas where smoking and tobacco use may be permitted. The content, lettering, size, color and location of required no-smoking signs shall be subject to the approval of the Fire Official.
B. 
It shall be unlawful for any person to obscure, remove, deface, mutilate or destroy posted no-smoking signs.
Any person who violates or permits a violation of this article shall be subject to a civil enforcement proceeding and, upon conviction, shall be sentenced to pay a civil penalty of not more than $600, plus all court costs, including reasonable attorneys' fees, incurred by the Township in the enforcement of this article. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Township are hereby authorized to file a complaint for summary violation and seek any other available relief at law or equity, including injunction, to enforce compliance with this article.
