The Town of Greenville via Resolution 2008-08 adopted a policy and procedures in conformance with Pennsylvania Act 3 of 2008, known as the "Right-to-Know Law,"[1] to provide for public access to public information, including financial records that are not exempt under Section 708 of PA Act 3 of 2008, not exempt from being disclosed under any other federal or state law or regulation or judicial order or decree or not protected by a privilege, and to designate an Open Records Officer to implement the policy and procedures.

A. 
Any person who is a citizen of the Commonwealth of Pennsylvania shall have the right to examine and copy any account, voucher, contract, minute, order or decision of the Town in accordance with PA Act 3 of 2008 and the procedure hereinafter set forth.
B. 
It is the policy of the Town to require the presence of a designated employee when public records are examined and inspected and to charge reasonable fees for duplication of the Town's public records. Greenville has designated the Town Manager as the Open Records Officer, who is responsible for assuring compliance with the Pennsylvania Right-to-Know Law.
C. 
All requests for public records of the Town under this policy shall be specific in identifying and describing each public record requested. In no case shall the Town be required to create a public record which does not exist or to compile, maintain, format, or organize a public record in a manner in which the Town does not currently compile, maintain, format, or organize the public record. All requests for public records shall be submitted in writing and include the date of the request, requestor's name, address, telephone number, certification of United States residency, signature of requestor, and if duplication is requested, appropriate payment as well. Rules and regulations governing access to public records shall be promulgated by the Town Manager in accordance with the Commonwealth of Pennsylvania's Right-to-Know Law. The Rules and Regulations shall be posted in the office of the Town Manager, in department offices and reception areas, as well as the Greenville Area Public Library and Greenville's official website.
No citizen shall have the right to examine or copy any records to which the laws of the Commonwealth of Pennsylvania or the Town in accordance with state law deny public access.
Any citizen shall have the right to appeal the denial of access to Greenville's public records in accordance with the Commonwealth of Pennsylvania, Right-to-Know Law.
A. 
The Town Council hereby declares its intent to follow the Municipal Records Retention and Disposition Schedule approved by the Local Government Records Committee pursuant to the Municipal Records Act of January 18, 1968, as amended (P.L. 961, No. 428) and take annual actions to maintain compliance with the schedule. All records of the Town shall be preserved for the period of time as may be designated in the Municipal Records Retention and Disposition Schedule for each type or category of municipal public record, including but not limited to administrative, emergency services, financial, fire, information technology, library, parks and recreation, payroll, personnel, planning and zoning, police, public health, public works, tax collection and assessment, waste management, and water quality records.
B. 
Maintenance and custody of all municipal records are under the responsibility of the Town Manager, except to the extent that the responsibility for certain records is expressly charged to any other unit of the Town by state or federal law, the Home Rule Charter or local ordinance; the retention and disposition schedule provisions of the Municipal Records Act of January 18, 1968, as amended.
