The intent of the Board of Trustees of the Village of Ellenville is to abolish and terminate the Ellenville Village Court System and the Village Justice position pursuant to its authority under Village Law §§ 3-301, 3-302 and 3-303. It is the intent of the Board of Trustees of the Village of Ellenville to terminate the Village Justice position, which is due for election November 8, 2022. The Village Justice position would continue until December 31, 2022, when the present term is due to expire. On December 31, 2022, the Ellenville Village Court System would cease to exist.
Effective December 31, 2022, the Village Justice position due for election on November 8, 2022, will terminate. Also effective December 31, 2022, the Acting Village Justice, if any, Village Court Clerk and all supportive services shall cease to exist.
On or after December 31, 2022, all matters necessitating the intervention of the local justice court system, both criminal and civil actions, originating in the Village of Ellenville or once adjudicated in the Ellenville Village Court System shall be docketed in the Town of Wawarsing Justice Court by virtue of the Village of Ellenville being located within the boundaries of the Town of Wawarsing.
Within five days of the effective date of this article, the Village Clerk of the Village of Ellenville shall file a copy of such article with the Clerk of the Town of Wawarsing and with the State Office of Court Administration.
This chapter shall take effect immediately upon filing with the Secretary of State; provided, however, that such chapter is subject to permissive referendum, and the Village Clerk shall forthwith proceed to notice such fact and conduct such referendum if required by petition.
