As used in this article, the following terms shall have the
meanings indicated:
RETAIL CONSUMPTION LICENSE
Retail food establishments as defined in New Jersey Administrative Codes Title 8, § 8:24 et seq., and licensed as same pursuant to the Township of Union Code Chapters
761 and
693 and in which no other business, except such as is incidental to such establishment, is conducted.
Except as otherwise provided in §
199-36, no person shall drink or otherwise consume any alcoholic beverage, or offer an alcoholic beverage to another person for the purpose of consumption, in any commercial establishment where persons congregate for any purposes whatsoever, unless such establishment holds a valid retail consumption license issued by the Township or the New Jersey Division of Alcoholic Beverage Control.
Except as otherwise provided in §
199-36, no person owning or operating any commercial establishment, whether or not food or beverages are sold or served on the premises, shall serve or permit or allow the consumption of alcoholic beverages on the premises, unless such establishment holds a valid retail consumption license issued by the Township or the New Jersey Division of Alcoholic Beverage Control.

The prohibitions contained in §§
199-34 and
199-35 of this article shall not apply to a retail food establishment licensed facility as defined in this section.

This article shall be enforced by any member of the Township
of Union Police Department and any Township of Union Health Inspector
who may issue a summons for a violation of any ordinance of the Board
of Health.

Any person violating any of the provisions of this article shall,
upon conviction thereof, be subject to one or more of the following:
imprisonment in the county jail or in any other place provided by
the municipality for the detention of prisoners for any term not exceeding
90 days or by a fine not exceeding $2,000 or by a period of community
service not exceeding 90 days, to become effective on the effective
date of this article.
