The City of Millville Dog Park, the use of which is governed by this article, is established and shall consist of a fence-enclosed area within the confines of Lot 127, Block 236, known as "Union Lake Park," 1414 Canal Street, Millville, New Jersey.
Unless otherwise specifically defined herein, words and phrases in this article shall be interpreted so as to give them the meaning that they have in common usage and to give this article its most reasonable application. The following terms shall have the meanings indicated:
DOG LICENSE
A current license issued by a governmental authority which represents that a dog has a valid, unexpired rabies vaccination. For information about licensing, see Chapter 8, Article I, Licensing and Control.[1]
KEEPER
Any person exercising control over a dog or permitting a dog to enter the Dog Park or permitting a dog for which he or she is responsible to remain in the Dog Park. The owner of a dog is also its keeper.

By entering the City of Millville Dog Park, any person agrees to accept the risk for any actions taken by or to himself or herself or his or her respective dog. All dog owners shall be strictly liable and responsible for any actions of their dogs, including any which cause injury to other dogs or persons while in or about the Dog Park of the City of Millville.

The Dog Park will be open for use from dawn until dusk, seven days per week.
A. 
The City of Millville shall promulgate rules and regulations which may be enforced by any member of the Police Department of the City of Millville, the Department of Parks and Public Property of the City of Millville or the City of Millville Animal Control Officer. Said rules and regulations shall include, at a minimum, the following:
(1) 
All keepers, including the owner of any dog, assumes all liability for damages to person or property caused by the dog for which they are responsible at and about the Dog Park, including injury suffered by anyone or any dog who is bitten or injured by their dog while utilizing the park or any dog allowed to access the park, and shall hold the City of Millville harmless for same.

(2) 
All keepers, including the owner, who utilize the Dog Park do so at their own risk of injury to selves and dogs. No attendant is on duty.
(3) 
Remove leashes in the designated "unleash area" only.
(4) 
Dogs must be supervised at all times by persons 18 years or older.
(5) 
Children under the age of 16 shall be accompanied by an adult when in the Dog Park.

(6) 
No unattended dogs are permitted in the park at any time; abandoning animals is prohibited by law.
(7) 
No more than two dogs are permitted per keeper at one time in the park.
(8) 
All keepers must accompany and monitor their dog's actions closely at all times and always have a leash ready and available for use as may be required.
(9) 
No smoking, alcohol, food or glass containers are permitted in the Dog Park. All personal property, debris, garbage and other wastes brought in or created by any keeper, guest, or dog shall be promptly removed at the end of each visit to the site. "Pooper scooper" bags are available in the park.
(10) 
Aggressive dogs are prohibited from utilizing the park. Dogs that become aggressive or uncontrollable while within or near the Dog Park must be immediately leashed and removed from the Dog Park and its surroundings. Reported cases will result in the loss of Dog Park privileges.
(11) 
Dogs that are in heat or that are sick are prohibited from entering the park. All dogs must be licensed and properly immunized. The use of heartworm and tick prevention products is highly recommended.
(12) 
Puppies over six months of age must have full immunizations to utilize the park. Puppies under the age of six months are not permitted in the park.
(13) 
Dogs within the Dog Park must wear collars with valid dog licenses. No prong (pinch), choke or spiked collars are permitted in the park.
(14) 
Keepers are responsible for ensuring that their dog only enters the appropriate fenced-in area based upon the size and weight of their dog.
(15) 
Keepers must immediately report any dog bites to the City of Millville Police Department.
(16) 
[1]Professional dog trainers are not permitted to use this facility for training purposes without written permission from the City.

(17) 
Keepers, guests and dogs must comply with this article, as well as other applicable laws, and the City of Millville's regulations either posted or given to them or available at the City Clerk's offices or City of Millville website. Either the dog owner or other keeper must maintain the required insurance for each of its dogs using the Dog Park.

(18) 
Keepers must ensure that all gates are closed at all times after entering and exiting.
(19) 
Equipment in the Dog Park is for dogs only. Children are not permitted to climb on or use the equipment.

The Dog Park is subject to closure for maintenance without notice.

B. 
Rules and regulations shall be posted and may be changed by the governing body via resolution as appropriate.

The keeper of the dog who brings a dog to the Dog Park, if said person is not the owner of said dog, shall be responsible for any violations of this article. A summons may be issued to either the person bringing the dog to the Dog Park or the owner thereof, or both, in the discretion of the individual issuing a summons.
Any person who violates any section of this article or any of the rules or regulations promulgated pursuant to this article shall, upon conviction, be subject to a fine of up to $2,000, imprisonment up to 90 days and/or community service up to 90 days in the discretion of the Municipal Court Judge and may be barred from further use of the Dog Park for such time as the Municipal Court Judge may determine.
