1. The following specific provisions shall apply to an application for
a Property Transfer Permit within the Borough of Phoenixville.
A. A property transfer permit shall be required prior to the transfer
of real property in the Borough of Phoenixville. It shall be unlawful
to use and/or occupy any structure, building and/or portions thereof
in any manner until a property transfer permit has been issued by
the Code Enforcement Department, having satisfied the requirements
of the Code of the Borough of Phoenixville, including, but not limited
to, the International Property Maintenance Code, the Uniform Construction
Code, the International Fire Code, the zoning ordinance, the terms
and conditions of this section, and any other applicable provisions
of the Code of the Borough of Phoenixville or the laws of the Commonwealth.
B. The application for a property transfer permit shall be submitted
on such form as the Code Official may prescribe.
C. The Code Official shall inspect any structure, building, yard, improvements
and/or land or portions thereof to determine compliance with this
chapter and permit requirements. If satisfied that the property is
in conformity with this chapter and any permit requirements, a property
transfer permit shall be issued pursuant to the guidelines set forth
by the Commonwealth's Municipal Code and Ordinance Compliance Act
(Act of Dec. 20, 2000, P.L. 724, No. 99.), as amended.
D. Upon inspection, the Code Official shall either grant or deny the
property transfer permit by providing the applicant with either the
property transfer permit or a written record of deficiencies within
five days from the date of last inspection.
E. A permit fee shall be assessed by the Code Enforcement Department
to include the cost of all administrative processes and up to two
inspections of the property. A reinspection fee shall be assessed
for each inspection thereafter wherein a property requires a third
or subsequent inspections under any application for a property transfer.
The fees shall be as fixed in an amount determined by Borough Council
set forth in the Master Schedule of Fees.
F. The property transfer permit shall be maintained at the Borough according
to the Commonwealth's Municipal Records Manual in effect.
