Unless contrary intention clearly appears, the following words and phrases shall have, for the purposes of this chapter, the meanings given in the following clauses and shall be interpreted as follows:
A. 
Words used in the present tense shall include the future.
B. 
The singular includes the plural.
C. 
The word "person" includes an individual, firm, partnership, corporation, company, association, or government entity, including a trustee, an assignee or similar representative.
D. 
The masculine form of the word includes the feminine and the neuter forms of the word.
E. 
The term "shall" is mandatory.
F. 
The term "may" is permissive.
G. 
The words "used" or "occupied," are applied to any land or building and shall be construed to include the words "intended, arranged or designed to be occupied."
H. 
The word "Council" and the words "Borough Council" always refer to the Phoenixville Borough Council, and "Borough" always references the Borough of Phoenixville.
I. 
The word "Code" or "Borough Code" refers to the complete body of legislation for the Borough of Phoenixville, as revised, codified and consolidated into chapters, parts and sections by General Code.
2. 
Any word or term not defined herein shall be interpreted according to the meaning of standard usage.

As used in this chapter, the following terms shall have the meanings indicated:
APPLICANT
An applicant for a connection to or additional use of the water system.
COMMERCIAL-INDUSTRIAL FACILITY
A facility used or designed for an activity carried on primarily for financial gain including, but not limited to, retail business, restaurants, recreational facilities, professional and service offices, social clubs and halls, manufacturing businesses, businesses involved in the production of a commodity or article, factories and any other use which is not included within one of the other definitions in this Part.
CUSTOMER
The legal owner of the property served or the person(s) or entity (e.g., a tenant) who is designated, on the Borough's billing records, as the party responsible for or to receive the bill for service.
CUSTOMER'S SERVICE LINE
The service connection from the curb stop, excluding the curb stop and curb box, which is the property of the customer.
DWELLING UNIT
Any room or group of rooms intended for separate occupancy as a single habitable residential unit with sleeping, cooking and lavatory facilities. In all cases, the determination of the Borough as to what constitutes a separate dwelling unit shall be final.
EQUIVALENT DWELLING UNIT or EDU
A unit of measure for determining water connection fees by the Pennsylvania Department of Environmental Protection (DEP), which unit equals 238.5 GPD.
GALLONS PER DAY or GPD
A peak daily average of the gallons of water which is or may be used, which average is used to determine the water connection fee.
INSTITUTIONAL FACILITY
A facility used or designed for use by a nonprofit organization (e.g., a church).
MULTIFAMILY DWELLING
A dwelling containing three or more dwelling units including, but not limited to, hotels, boardinghouses, apartment houses, etc.
RESPONSIBLE PARTY
The legal owner(s) of the property served and any customer, other than such owner, who has received the service (e.g., a tenant) and any other party who can be held responsible, pursuant to any applicable law, for any obligation under this Part (example being through an executed copy of agreement).
SINGLE-FAMILY DWELLING
A residential building containing one dwelling unit with a customer's service line used only by the dwelling.
USE
Each dwelling unit and each separate business, profession, occupation, leasehold and/or condominium which or where an operation or activity is or is intended to be conducted, whether commercial, industrial, institutional or other nonresidential use except sprinkler connections.
WATER CONNECTION FEE(S)
Charge(s) for water system capital costs, assessed against the owner of the property.
WATER DEPARTMENT'S SERVICE LINE
The service line running from the main, including the curb stop and curb box, which is the property of the Water Department of the Borough of Phoenixville.
WATER SYSTEM
All of the facilities of the Borough for the supplying of water to consumers.
