The title of this chapter shall be "the Term Limits Law."
It is the intent of the Town Board of the Town of West Seneca to expand participation in the electoral process and to bring new ideas to governance of the Town of West Seneca. Except as limited by § 40-6, the Town Board of the Town of West Seneca adopts this chapter to limit terms of office for elected officials in the Town of West Seneca.
The number of terms that a person can be elected to and serve in the same public office shall be limited to two terms of four years each, regardless of whether said terms are served consecutively or nonconsecutively. If a person has already been elected to two four-year terms in that same public office prior to the November 2nd, 2021, general election, they will be allowed to seek, be elected, and to serve one additional four-year term in that same public office.
Nothing contained herein shall prohibit an elected public official in the Town of West Seneca from holding either an elected or appointed partial term in the same elected public office, prior to being elected to a full four-year term. That partial term shall not be counted for the purposes of term limitations imposed by this chapter.
Nothing contained in this chapter shall prohibit an elected public office holder from seeking, being elected to, or holding a different elected public office for the Town of West Seneca than the one for which they have reached the term limitations. For the purposes of this chapter, the elected offices of Town Supervisor and Town Council Member shall be considered as different elected public offices, each with a limit of two terms of four years each.
Nothing contained in this chapter shall apply to the elected offices of Town Justice, Town Clerk, or Town Highway Superintendent.
This chapter is enacted pursuant to § 10(1)(ii)(a) of the Municipal Home Rule Law of the State of New York which authorizes towns to adopt local laws concerning the mode of selection and terms of office of elected officials.
This chapter shall become effective immediately upon its enactment by the Town Board after proper filing, including filing with the office of the State Comptroller and the Office of the Secretary of State.
