The Borough of Pompton Lakes shall adopt by reference the regulations as set forth in N.J.A.C. 7:9A et seq.

Every contractor or person in charge of any construction or repair work in the Borough shall provide toilet accommodations for the persons engaged in such construction or repair work whenever it shall be deemed necessary by the Department of Health. If connection with the Borough sanitary sewer is not practicable, then application shall be made for a permit to install and maintain a temporary portable chemical toilet of a commercial type approved by the Health Officer or designee. All portable chemical toilets shall be maintained in a clean and sanitary condition.

A. 
No person shall construct, reconstruct, alter or extend, or cause to be constructed, reconstructed, altered or extended, in the Borough any individual sewage disposal system or part thereof unless a permit therefor has first been obtained by the contractor from the Department of Health as hereinafter provided. All permits issued under this section shall expire six months from the date of issuance.
B. 
A permit to alter, repair or construct an individual sewage disposal system or part thereof shall not be used unless the contractor provides proof of the following:
1. 
A current and valid N.J. Home Improvement Contractor License;
2. 
All other current valid licenses and certifications required for the system proposed in accordance with N.J.A.C. 7:9A et seq.
C. 
Contractor must complete all work in accordance with N.J.A.C. 7:9A et seq. within 30 days of the system being backfilled. Should the contractor fail to do so, he/she shall be subject to a penalty of $100 per day payable weekly to the Borough of Pompton Lakes for each day beyond 30 days that the work remains incomplete.

The fees for permits required under § BH:13-3 of this chapter shall be as provided in Chapter BH:7, Fees.

A. 
No person shall engage in the business of emptying or cleaning any individual sewage disposal system or part thereof without first registering with the N.J. Department of Environmental Protection.

A. 
Approval of an individual sewage disposal system shall not become effective until the designing engineer provides two sealed as-built drawings and two sealed certificates of compliance to the Department of Health.
B. 
The designing engineer must provide the documents referred to in paragraph A. within 30 days of the system being backfilled. Should the engineer fail, the engineer shall be subject to a penalty of $100 per day payable weekly to the Borough of Pompton Lakes for each day beyond 30 days that he/she has not provided the required documents as referred to in paragraph A.
