In accordance with Chapter V, Section 1B and Chapter III, Section 6 of the Charter of the City of Middletown, the Department of Land Use is created.
A. 
The Department shall consist of a Director and such other staff as may be deemed necessary by the Mayor and the Common Council.
B. 
The Department of Land Use will be responsible for implementing the City's land use policies and will have regulatory oversight over the environment and protection of natural resources within the City of Middletown.
The Department of Land Use assists in the creation and implementation of the Middletown Plan of Conservation and Development, which is the basis for all land use decisions with the intent to protect its citizens' health, safety, general welfare, and property values. The Land Use Department administers the City's Zoning Code, Subdivision Regulations, and Inland Wetlands and Watercourse Regulations for all development projects in the City and ensures that development applications are in compliance with both local and statutory requirements. Specifically, the department will:
A. 
Assist in the development and implementation of the Plan of Conservation and Development;
B. 
Provide technical and administrative assistance to the Planning and Zoning Commission, the Inland Wetlands and Watercourse Agency, the Commission on Conservation and Agriculture, the Zoning Board of Appeals, and other related City boards, commissions, and committees as designated;
C. 
Review and ensure that the use of land and land use applications comply with local zoning codes, subdivision and wetlands regulations, as well as relevant state and federal law;
D. 
Protect the public health, safety, and welfare by enforcing the City's anti-blight ordinances; and
E. 
Assist the City in open space acquisition and protection of natural resources.
