The adoption of this article is in accordance with § 10
of the New York Municipal Home Rule Law, and expressly supersedes
New York Public Officer Law, including § 3 thereof, New
York Town Law, including §§ 20 and 23 thereof, and
any other New York law to the extent such law(s) requires a Town Comptroller
to be a resident of the Town.
This article shall be known as and may be cited as "Local Law
No. 2 of 2021, to Modify Residency Requirements for Town of Walworth
Comptroller." The purpose of this article is to modify the residency
requirement for the Town of Walworth Comptroller to a less restrictive
residency requirement; that is, to require residency within the County
of Wayne (instead of just within the Town of Walworth itself), so
as to have a broader range of individuals eligible for the Town Comptroller
position.
The Walworth Town Board finds that the residency requirement
for the Town of Walworth Comptroller shall be modified to a less restrictive
residency requirement; that is, to require residency within the County
of Wayne (instead of just within the Town of Walworth itself), so
as to have a broader range of individuals eligible for the Town Comptroller
position.
In the Town of Walworth, New York, the provisions of New York
Public Officers Law and/or New York Town Law at §§ 20
and 23, which require a Town Comptroller to be a resident of the Town,
are hereby expressly superseded for the position of Town Comptroller
in the Town of Walworth. Instead, anyone holding the position of Town
Comptroller in the Town of Walworth shall be a resident of Wayne County,
New York.
