The Town hereby establishes a Government Energy Aggregation
Program, in accordance with the provisions of the Government Energy
Aggregation Act, N.J.S.A. 48:3-93.1 et seq.

The Mayor is authorized to execute and the Clerk to attest to
the execution of an electric distribution aggregation agreement, in
a form acceptable to the Town, with PSE&G.

The Town Council will act as lead agency of the WCEP and, in
that capacity, and consistent with applicable rules, will solicit
proposals for electric generation service and energy aggregation services
on behalf of Town residents and businesses, and enter into a contract
for such services, provided that the lowest qualified bid containing
renewable content in the power supply is above the basic generation
supply of the current default supplier.

As lead agency, the Town Council will execute a master performance
agreement that obligates the participants in the WCEP to purchase
electricity at terms and conditions stated therein with a third-party
supplier who has been awarded the contract by the lead agency on behalf
of participating members of the WCEP, and provided that such contract
shall be at prices reasonably forecast and estimated by the Mayor
and the Town Council to provide increased renewable content in the
power supply relative to the basic generation service by PSE&G.

The authorization provided to the lead agency shall be valid
until December 31, 2023 (the "effective period"), at which time the
WCEP will be subject to renewal at the discretion of the Town Council.

All ordinances or parts of ordinances in conflict or inconsistent
with any part of this article are hereby repealed to the extent that
they are in conflict or inconsistent.

In the event that any section, provision, or part of provision
of this article shall be held to be unenforceable or invalid by any
court, such holding shall not affect the validity of this article
as a whole, or any part thereof, other than the part so held unenforceable
or invalid.
