1. This Part may be cited as "The Handicapped Parking Ordinance of the
Borough of Wyoming," and said hereinafter referred to as the "Reserved
Residential Handicapped Parking Ordinance."
2. Purpose. The Borough of Wyoming, recognizing the special needs of
handicapped persons in the Borough, hereby establishes a handicapped
parking program which will facilitate access to and from the handicapped
persons' place of residence.

As used in this Part, the following terms shall have the meanings
indicated, unless a different meaning clearly appears from the context:
HANDICAPPED PARKING SIGN
A sign or signs issued by the Borough reserving parking for
specific handicapped tagged vehicle(s) erected at a designated area
for access for handicapped persons who applied for and secured the
reserved space pursuant to the terms and conditions set forth in the
Borough Code.
HANDICAPPED PERSON
An individual possessing a handicapped or severely disabled
veteran registration plate as issued by the Pennsylvania Department
of Transportation.

1. The Borough of Wyoming will promulgate and have available applications
for handicapped parking signs. Said applications can be obtained from
the Borough Manager at the Municipal Building during regular business
hours. Once the application has been completed, it shall be submitted
to the Borough Council for consideration.
2. Application Fee. Upon submission of the application, the applicant
shall include a check or money order in the amount of the $100, made
payable to the Borough of Wyoming. This is to cover the costs of the
signs and posts as well as the administrative and labor costs associated
with installation of the signage. It is understood that when the handicapped
signs are no longer needed, they shall become the property of the
Borough. Said application fee will be refundable in full to the applicant
if it is determined that the application is disapproved by the issuing
authority. The initial cost shall be as set from time to time by resolution
of Borough Council. If existing sign holders wish to add an additional
sign, they must pay a fee as set from time to time by Council for
the additional sign. If the old sign has to be removed and installed
again, then that sign will have to be paid for as well. The costs
to install the signs may be amended via resolution as labor and material
costs increase.
3. All approved applications shall be subject to bi-annual review and
are subject to revocation for cause shown.
4. Applicants must possess a handicapped or severely disabled veteran
registration plate in order to obtain an application. Said license
plate must match the application and will be listed on the sign. Only
that vehicle shall be able to park in that spot.
5. Applications are to be completed in their entirety.
6. Approval or denial of applications will be made within 45 days by
the issuing authority.
7. Upon approval of an application and payment of requisite fees, the
Borough will erect one handicapped parking sign as near as practicable
to the applicant's residence, with the sign displaying the vehicle
registration plate which will be authorized to use the reserved space.
The only vehicles which will be permitted to be parked in the reserved
space will be those vehicles bearing the registration plates set forth
on the signage. Any other person who parks in this space will be subject
to immediate towing, with towing costs to be paid by the violator.
Further, any unauthorized person using the space will be subject to
the penalties set forth in this Part.
8. The Borough of Wyoming shall maintain a log of all approved applications
and permits issued for handicapped parking signs and shall provide
the Wyoming Borough Police Department a copy thereof.

1. In November of every even numbered year, a renewal form will be sent
out to every Borough resident that has a handicapped license plate.
If the plate is still required, the resident shall be fill out the
renewal form and provide a fee of $10 to cover the administrative
expense of the renewal application.
2. If the renewal application and fee are not submitted to the Borough
by December 31 of every even-numbered year, then said handicapped
parking sign shall be removed from the residence.
3. If the renewal application is not received by December 31 of every even numbered year, and the resident still requires a handicapped parking space, they will be required to reapply under the terms set forth in §
15-1203.

1. It shall be unlawful for any person to erect handicapped parking
signs in the Borough of Wyoming without first making application to
the Borough. Any person who erects or utilizes handicapped parking
signs who has not followed the requirements of this Part is subject
to penalties set forth herein.
2. Any stipulations made at the time of application regarding the eligibility
of any applicant shall be updated periodically at the request of the
issuing authority.
3. Handicapped parking signs shall not supersede existing parking regulations,
including, but not limited to, street sweeping, snow parking ban or
snow removal regulations.
4. The issuing authority shall be notified immediately if an eligible
person no longer qualifies for a sign under this article; for example,
if an eligible person enjoys an improved health condition or moves
from the premises wherein the sign is located. They shall notify the
issuing authority in the event of relocation, improved health, or
in the case of death, their survivors shall notify the Borough. Failure
to notify the issuing authority constitutes a violation of this article.
5. The issuing authority shall take the following factors into consideration
when issuing handicapped parking signs:
A. Overall availability of parking in the area wherein a sign is requested.
B. Living arrangements of an individual applicant; for example, a disabled
person living alone and responsible for his or her own transportation.
C. Existing parking problems in the area where a sign is requested.
D. Availability of off-street parking.
6. The Borough reserves the right to remove any handicapped parking
signs for cause shown.

1. Any vehicle parked in a handicapped parking space which is not displaying
the specifically designated registration plate(s) shall be subject
to a fine of $50 for parking violations in handicapped parking spaces.
2. Failure to respond to a Borough parking ticket will cause a citation
to be filed against the violator in the office of the Magisterial
District Judge.
3. Any person violating any of the other provisions of this Part shall,
upon conviction thereof, be sentenced to pay a fine and be subject
to imprisonment consistent with the penalties set forth in the Pennsylvania
Vehicle Code for violations of handicapped parking.

All provisions of this Part are severable. If any provision
of this Part or its application is held invalid, such invalidity shall
not affect any other provision of application of this Part which can
be given effect without the invalid provision or application.
