The Town shall have all the powers now or hereafter granted
to the Town by the home rule and other provisions of the Constitution
and General Laws of the state and shall have complete powers of legislation
and administration in relation to its municipal functions together
with all powers implied in or incident to the powers expressly granted.
The Town shall have power to enact ordinances and to make rules and
regulations necessary and proper for carrying into execution the powers
and such ordinances may be made enforceable by the imposition of fines,
forfeitures and penalties. The Town may acquire property within or
without its corporate limits for any public purpose, in fee simple
or any lesser interest or estate, by purchase, gift, lease, devise
or condemnation, and may sell, lease, mortgage, hold, manage and control
such property as its interests may require: and except as prohibited
by the Constitution of this state, or restricted by this Charter,
the Town shall have and may exercise all municipal powers, rights,
privileges and immunities of every name and nature whatsoever. The
enumeration of particular powers by this Charter shall not be deemed
to be exclusive, and in addition to the powers enumerated therein
or implied thereby, or appropriate to the exercise of such power,
it is intended that the Town shall have and may exercise all powers
which under the Constitution of this state are permissible expressly
or impliedly for this Charter to specifically enumerate.
All laws relating to the Town are hereby superseded to the extent
that they are inconsistent with the provisions of this Charter except
such laws as are enacted in accordance with the powers reserved to
the General Assembly by the Constitution of this state.
Except insofar as they are inconsistent with this Charter, all
the ordinances, rules, regulations, and resolutions heretofore enacted
by the Council and any board or commission shall continue in effect
until superseded by action of the Council.
To the extent that any specific provision contained in this
Charter conflicts with any provision expressed in general terms, the
specific provision shall prevail.
The Town may exercise any of its powers or perform any of its
functions and may participate in the financing thereof, jointly or
in cooperation, by contract or otherwise, with any one or more state,
or civil divisions or agencies thereof, or the United States or any
agency thereof, provided that the other political entity or entities
have the same power by charter or legislation to similarly contract.
