For the purposes of this division, the following words and phrases shall have the meanings as set forth below:
MOBILE TELEPHONE ACCESS PARKING ZONE
Any street or off-street parking lot upon which parking is restricted to vehicles for which a fee has been paid via a mobile telephone.
OPERATOR
A person who is in actual physical control of a vehicle.
PARK or PARKING
The standing or waiting of a vehicle, whether occupied or not, upon a street, road, highway or off-street lot, not actually engaged in receiving or discharging passengers or merchandise or in obedience to traffic regulations, signs or signals, or an involuntary stopping of the vehicle by reason of causes beyond the control of the operator of the vehicle.
PERSON
Associations, firms, partnerships and bodies politic and corporate, as well as individuals.
RESTRICTED PARKING SPACE
Any parking space within a mobile telephone access parking zone and which is duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the curb or on the surface of the street.
STREET
A public highway, road, avenue, court, lane or alley, including a sidewalk or footpath, unless the contrary is expressed or unless such meaning would be inconsistent with the manifest intent of the Township Council.
VEHICLE
Every device in, upon or by which a person or property is or may be transported upon a street or highway, excepting devices moved by human power or used exclusively upon stationary rails or tracks.

The following named and described areas, streets or portions of streets and such other areas, streets or portions of streets as may hereafter be included in this section by amendment hereto, lying within the corporate limits of the Township, shall constitute a mobile telephone access parking zone:
(a) 
Beverly Road-River Road municipal parking lot.
(b) 
Phelps Park municipal parking lot.
(c) 
State Street municipal parking lots.

The Township Police Department is hereby directed and authorized to have lines or markings durably painted or placed upon the curb, sidewalk, street or parking lot surface so as to mark off individual parking spaces in the mobile telephone access parking zone designated and described in § 36-32.4 and in such other zones as may hereafter be established.

(a) 
The Township Manager is hereby authorized to contract for mobile telephone access parking services referred to in this division. In connection therewith, the Township Manager is granted the authority to negotiate for a contract or contracts for mobile telephone access parking services.
(b) 
The appropriate officers of the Township in which such power is vested are authorized to enter into and execute such contract or contracts as may be negotiated by the Township Manager, after approval of the terms and conditions thereof by the Township governing body.

(a) 
In establishing mobile telephone access parking zones, signage shall be installed upon the street, curb or parking lot surface in the vicinity to the individually marked parking spaces hereinbefore described, indicating the legal parking time established by the Township, the fee for the privilege of parking for such period of time, the name of the mobile telephone access parking service provider designated by the Township and the telephone number to call to pay the fee or obtain the appropriate mobile telephone app for such service provider.
(b) 
No mobile telephone access parking zone shall be designated in any location where parking is prohibited by N.J.S.A. 39:4-138.

(a) 
Any vehicle parked in a mobile telephone access parking space shall be parked between the lines used to mark off individual parking spaces so that the front part of such vehicle is nearest to the curb for angle or perpendicular parking or for parallel parking, along the adjacent curb so that the vehicle is parked in the direction of travel.
(b) 
When any vehicle shall be parked in any mobile telephone access parking space, the operator thereof shall, immediately upon entering the mobile telephone access parking space, contact the mobile telephone access parking service provider designated by the Township either via the appropriate mobile telephone app for such service provider or by calling the service provider on the telephone number designated on the signage for such mobile telephone access parking zone and pay the required fee therefor by said app or via telephone.
(c) 
Upon the payment of the required fee, the mobile telephone access parking space may lawfully be occupied by such vehicle during the parking time period for which the required fee is paid but not exceeding the maximum time period which has been prescribed for the part of the street or parking lot area in which such space is located. If such vehicle shall remain parked in such space beyond the parking time limit set for such space, or if the time period for which the fee has been paid has expired, then, and in that event, such vehicle shall be considered as parking overtime, and such parking shall be deemed a violation of this division.

(a) 
Parking a vehicle in a designated space in a mobile telephone access parking zone in the lot designated in § 36-32.4(a) shall be lawful for a total of 120 minutes upon the payment of a mobile telephone access parking fee of $1 for each hour of time (exclusive of any on-demand user fee charged by the mobile telephone access parking service provider). Said mobile telephone access parking spaces shall be operated every day for a full 24 hours, seven days per week, no holidays excepted.
(b) 
Parking a vehicle in a designated space in a mobile telephone access parking zone in the lot designated in § 36-32.4(b) shall be lawful for a total of 180 minutes upon the payment of a mobile telephone access parking fee of $1 for each hour of time (exclusive of any on-demand user fee charged by the mobile telephone access parking service provider). Said mobile telephone access parking spaces shall be operated every day for a full 24 hours, seven days per week, no holidays excepted.
(c) 
Parking a vehicle in a designated space in a mobile telephone access parking zone in the lot designated in § 36-32.4(c) shall be lawful for a total of 180 minutes upon the payment of a mobile telephone access parking fee of $1 for each hour of time (exclusive of any on-demand user fee charged by the mobile telephone access parking service provider). Said mobile telephone access parking spaces shall be operated Monday through Friday, except holidays, between 8:00 a.m. and 6:00 p.m.

It shall also be unlawful for any person to:
(a) 
Permit any vehicle to remain or be placed in any mobile telephone access parking space in excess of the time period for which a fee has been paid or in excess of the time limit set for such space.
(b) 
Park any vehicle across any line or marking of a mobile telephone access parking space or in such position that the vehicle shall not be entirely within the area designated by such lines or markings.
(c) 
Deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any signage installed under the provisions of this division.

It shall be the duty of the Township Police Department to enforce the provisions of this division.

(a) 
Any person who violates § 36-32.8 or § 36-32.10, Subsection (a) or (b), shall be deemed guilty of an offense and shall be liable to the penalties provided by § 36-6.
(b) 
Any person who violates § 36-32.10, Subsection (c), shall be deemed guilty of an offense and shall be liable to the penalties provided by § 1-6.
