A. 
The collection of municipal waste, recyclable materials, and leaf waste from single-family residential establishments shall be performed exclusively by the municipal waste collector and recycling collector selected by the Township to provide such service or by multiple municipal waste or recycling collectors if the Township chooses, in its sole discretion, to permit multiple municipal waste or recycling collectors to provide such service. Collection shall be in accordance with any agreements as may be established and modified from time to time by resolution of the Board of Supervisors.
B. 
In the event that the Board of Supervisors enters an exclusive agreement with a municipal waste collector or recycling collector for single-family residential establishments, or permits multiple municipal waste or recycling collectors for single-family residential establishments, it shall be a violation of this chapter for any person not duly authorized by the Township to collect or cause to be collected municipal waste, recyclable materials or leaf waste from single-family residential establishments placed at the curb or any other place designated for collection.
C. 
The storage and collection of all municipal waste from single-family residential establishments shall comply with the following:
(1) 
All municipal waste shall be securely bundled or bagged and stored in the waste containers acceptable to the Township's municipal waste collector.
(2) 
The collection of municipal waste shall be made by the Township's waste collector a minimum of once per week.
(3) 
Each waste container shall be securely closed and placed at curbside by 6:00 a.m. on the day designated by the Township's municipal waste collector for collection. "Curbside" refers to that portion of right-of-way adjacent to Township roads. Waste containers shall be placed as close to the roadway as practicable without interfering with or endangering the movement of vehicles or pedestrians including sight obstructions.
(4) 
Only municipal waste in the waste containers will be picked up on regular collection days.
(5) 
The storage of all municipal waste shall be practiced as to prevent the attraction, harborage or breeding of vectors, insects and/or rodents and to prevent conditions in any way harmful to the public health or which creates safety hazards, odors, unsightliness or public nuisances.
D. 
The Township may designate up to one regular collection day each month for bulk waste collection of one bulk waste item by the Township's municipal waste collector.
A. 
Collection of municipal waste for multifamily residential, commercial, institutional and municipal establishments is not handled by the municipal waste collector selected by the Township to provide collection services from single-family residential establishments. The owners, landlords or agents of owners or landlords of multifamily residential, commercial, institutional and municipal establishments shall contract for their own collection of municipal solid waste, subject to, as applicable, federal, state, county and Township laws and regulations, the Chester County Solid Waste Management Plan and any future revisions thereto, and this chapter.
B. 
The storage and collection of all municipal waste from multifamily residential, commercial, institutional and municipal establishments shall comply with the following:
(1) 
Each owner, landlord or agents of owners or landlords of a multifamily residential, commercial, industrial and municipal establishment shall provide approved waste containers sufficient in number and size to contain all municipal waste generated by such uses between regularly scheduled collection and shall place and keep or cause to be placed and kept all municipal waste therein. The owner, landlord, or agents of owners or landlords shall maintain such container(s) so that no municipal waste shall be permitted to be placed around the container or spill or overflow therefrom. Collection shall be scheduled at least once per week.
(2) 
Waste containers shall be made of durable, watertight, rust-resistant material having a close fitting lid and any necessary handles to facilitate collection. Any cracked, rusted or otherwise improper container shall constitute a public nuisance and shall be removed from the property on or before the next collection day.
(3) 
It shall be unlawful to permit the accumulation of residue of liquids, solids or a combination of such material on the bottom or sides of waste containers. The interior of containers shall be kept clean by thorough rinsing, draining and disinfection as often as is necessary in order to prevent odor and accumulations of residue.
(4) 
The storage of all solid waste shall be practiced so as to prevent the attraction, harborage or breeding of vectors, insects and/or rodents and to prevent conditions in any way harmful to the public health or which create safety hazards, odors, unsightliness or public nuisances.
(5) 
Waste containers shall be located on such properties and buffered as may be required by Township ordinance.
A. 
It shall be the duty of every person owning a single-family residential, multifamily residential, commercial, institutional or municipal establishment where municipal waste is generated and accumulated within the Township to ensure the sanitary and legal disposal of such materials in accordance with all Township, county, state, and federal laws, regulations and ordinances, including but not limited to Act 101, the Chester County Solid Waste Management Plan, and any future revisions thereto, and this chapter.
B. 
It shall be unlawful to dump, burn, bury, destroy, process or otherwise dispose of any municipal waste within the Township, except in accordance with this chapter and the Pennsylvania Department of Environmental Protection and the Chester County Solid Waste Management Plan, as may be amended from time to time.
C. 
All municipal waste produced, collected and transported from within the jurisdictional limits of the Township shall be disposed of in a manner and at the facilities designated in the Chester County Solid Waste Management Plan and any future revisions thereto. Disposal shall comply with all applicable federal, state, county and Township laws, regulations, and ordinances.
D. 
It shall be unlawful for any person to bring any municipal waste into the Township or to transport municipal waste from one address to another within or outside of the Township for the purpose of taking advantage of the collection service or to avoid the cost of collection.
E. 
No person shall dump or deposit municipal waste on any other public or private property in the Township.
F. 
Nothing contained herein shall be deemed to prohibit any person not regularly engaged in the business of collecting municipal waste from hauling his own municipal or bulk waste on an irregular and unscheduled basis to a state-permitted disposal facility in accordance with the regulations of the disposal facility.
G. 
All construction debris shall be disposed of as permitted by applicable Township, state, and federal laws, regulations and ordinances and shall not be commingled with municipal waste. It shall be the responsibility of the property owner to ensure the disposal of construction debris in accordance with applicable laws, regulations and ordinances. Nothing contained herein shall be deemed to prohibit any person not regularly engaged in the business of collecting municipal waste from hauling his own construction debris to a state-permitted disposal facility in accordance with the regulations of the disposal facility.
H. 
Nothing contained herein shall prohibit a farmer from carrying out normal farming operations, including composting or spreading of manure or other farm-produced agriculture waste, not otherwise prohibited or regulated for land applications. All such practices must be conducted in compliance with applicable Township, state, and federal laws, regulations and ordinances.
I. 
All hazardous or residual waste must be disposed of in compliance with applicable Township, state, and federal laws, regulations, and ordinances, and shall not be commingled with municipal waste.
J. 
The Board of Supervisors may adopt reasonable rules and regulations for the purpose of carrying out the intent and purpose of this article.
